Diplomatic Interpreting: Misunderstood and little known.

Dear colleagues:

During the last month we have seen plenty of diplomatic activity around the world, most of which involved the president of the United States. First, president Trump met with North Korea’s leader Kim Jong Un in Singapore; next, he met with several heads of state in Europe during the NATO meetings, and after his visit to the United Kingdom where he needed no interpreter, he met Russian president Vladimir Putin in Helsinki.

Through current 24-hour news coverage around the world, these encounters and press conferences have put diplomatic interpreters on the spotlight in an unprecedented way. Diplomats and politicians have always known the role of the diplomatic interpreter in these events, but journalists, social media users, and TV viewers are just discovering the importance and complexity of this essential function needed in all diplomatic exchanges when the parties share no common language.

The interpreting profession is growing all over the world, but most of its expansion is coming from the legal, healthcare, and community service fields; therefore, diplomatic interpreting is also new to many interpreters who never had an opportunity to do it.

Many of our colleagues seized the opportunity to highlight the difference between translating and interpreting by constantly bombarding all social media with entries correcting the term used by journalists and lay people, and making it crystal clear that (at least in languages with different words to describe interpreting and translating) those accompanying the presidents were interpreters, not translators. Many of their social media comments showed they knew little about diplomatic interpreting. Look at these remarks found on social media and interpreter forums and chatrooms: “…the interpreters working the summit hopefully demanded team interpreting…Did they consider that North Korean is a different dialect when assigning Trump’s interpreter?…Did they tell interpreters that Kim Jong Un has a Swiss accent?…Kim Jong Un speaks English, but they needed an interpreter to clean up Trump’s remarks…interpreter better watch diplomacy if president does not…Who would want to interpret for Trump?…I bet these interpreters will write a book after the summit…; or this one: “…Why would a woman interpret for Putin and Trump?…

Diplomatic interpreting is a very specialized field. It requires the same skills needed to interpret in other fields, plus other technical, cultural, ethical and diplomatic knowledge and abilities, and self-confidence, courage, stress control, and refraining from showing personal emotions and opinions. It includes a broad range of elements and factors that make communication possible at presidential level, ministries, international organizations, and international military organizations.

Besides all modes of interpretation used in all other settings, diplomatic interpreting requires impeccable consecutive interpreting that goes beyond memory, note taking and visualization; it also needs of the interpreter’s insights, observations, impressions and readings derived from discreet but careful eye contact with the source and target, which must incorporate body language, gestures, and intonations to convey the most accurate rendition, this while walking on eggshells  in a world where nuances are extremely important. Often working with no equipment, diplomatic interpreters must project their voice so they can be heard by the target.

Diplomatic interpreters must possess an excellent simultaneous delivery with the right decalage and comprehension of the issues discussed to provide the right meaning in those topics being addressed at the meeting or conference. They work in the booth like all conference interpreters, but they also constantly interpret simultaneously performing chuchotage escort interpreting for the head of state. This requires additional skills not always needed in the booth, such as extreme concentration to isolate the voice of the source during a state dinner while many others are speaking. Both, consecutive and escort diplomatic interpreting are rendered at an unprecedented level of stress and pressure.

Sometimes, the job goes to somebody not qualified to be a diplomatic interpreter and the consequences can be ugly. This was the case during Mexican president Felipe Calderón’s visit to the White House in 2010 when he addressed president Barack Obama about pending immigration policy and legislation in the United States. In Spanish, Calderon’s comments were straightforward and clear as he spoke to the common values and principles that united the United States and Mexico. A halting and grammatically incoherent English rendition by the Mexican interpreter followed. The interpretation was so difficult to understand that the American delegation ignored the rendition and used a written translation instead. The Mexican delegation blamed its own translation, and from that point on, president Calderón spoke in English until another interpreter joined his team in Ottawa where his trip continued after Washington, D.C. The Mexican government indicated that the interpreter had come with the presidential delegation, but apparently this individual did not regularly interpret for Calderón. (NBC News. Those who are chosen to work as diplomatic interpreters must have broad knowledge and keep up to date with world political, social, and economic affairs. Keeping abreast of international developments and the issues at stake is essential for interpreters working in any language mediation setting.  Diplomatic interpreters must be familiar with dress codes, etiquette, demeanor, the correct form to address dignitaries, tact, and savoir-faire, the principles of being discreet and of not censoring. However, sometimes they must use harsh language when the source does so. In December 1983 then vice president George H.W. Bush went on a secret mission to El Salvador in a civil war. Stephanie Van Reigersberg, when head of the interpreting division of the Office of Language Services of the U.S. Department of State was assigned to accompany him. Bush was there to deliver a warning to a group of military commanders about the government’s death squads. Secret Service agents recommended the vice president call off the meeting, but he refused. “Basically, he cursed them out” Van Reigersberg said. “…having a woman interpreter using that kind of language really got their attention”. After the meeting, she realized that she had been so concentrated on her work she had lost any sense of danger until Bush remarked: “…well, I almost got us both killed, didn’t I?”

Each country has its own internal policy and criteria to select and appoint diplomatic interpreters; for security reasons, most nations choose staff interpreters vetted and cleared as ethical, professional individuals worthy of their nation’s trust. Some others select independent contractors then subjected to rigorous background checks and assigned a security clearance level, with only those with the highest level being assigned for top diplomatic interpretations. Finally, many countries have a mixed system where staff interpreters are used for the most common and widely spoken languages, while independent contractors with top security clearance are retained to interpret in less common languages. In the United States, interpreting for White House and State Department officials is provided by the Office of Language Services (part of the U.S. Department of State). Often, the diplomatic interpreter accompanying the head of state is the highest interpreter in their home country. A diplomatic interpreter is not just selected from an interpreters’ association directory on line. They are trusted, vetted, and tested professionals recognized for their skill and field of expertise. Thoroughness is essential in this work, it is never a matter of finding an equivalent or substituting a word; the interpreter must understand the thought expressed and its underlying meaning to interpret. Interpreters must know the specialized jargon and background information. You cannot interpret what you cannot understand. It is crucial that interpreters have all needed knowledge for each assignment. Sometimes they are privy to the same briefing the president gets; often, because of the delicate matters to discuss, information is subject to secrecy and interpreters only get it at the right moment, but always with time to be prepared for the job. Words are so important in diplomatic interpreting that sometimes they can set the mood for a negotiation: During a U.S.-Soviet summit in Washington, D.C. in December 1987, president Reagan welcomed his cold war rival Gorbachev to the White House to discuss peace. During the official welcoming ceremony, Reagan stated that: “…today marks a visit that is perhaps more momentous than many…because it represents a coming together not of allies, but of adversaries…” The U.S. interpreter on that occasion was Dimitry Zarechnak, and the Soviet interpreter was the legendary Pavel Palazhchenko. When it came the time to interpret the speech, Zarechnak told National Public Radio (NPR) in 2001 he was “…agonizing over the word adversaries” because the Russian word for “adversaries” protivniki, sounds similar to a word that means “disgusting”: protivniy. “…In English, you can have a noble adversary. In Russian it sounds terrible…” he added. Instead of repeating the word “adversaries”, Zarechnak used a Russian word for “competitors” which Gorbachev liked. This same word was used by president Trump this week when he was asked if president Putin was his enemy and he replied that “…I have always said he is (my) competitor…” (National Public Radio NPR (https://www.npr.org/2018/06/11/611734103/the-pressure-of-being-an-interpreter-at-a-high-stakes-summit)

Occasionally, interpreters are indirect recipients of a tense internal relationship within a government structure. This can affect their work and their preparation.  During the Nixon administration, president Richard Nixon and Henry Kissinger distrusted the State Department and had a less than friendly relationship with secretary of state William Rogers, sometimes they kept the U.S. interpreters out of the meetings for fear they would brief Rogers. This meant that sometimes the interpreters would assist in meetings between the secretary of state and foreign leaders on topics about which the White House had kept the interpreters in the dark. Some say that these interpreters participate in making history. This is both: a privilege because they get to be eyewitness to some events that will be in the history books of tomorrow; and a burden because it means more stress and pressure which translate in tremendous responsibility. Interpreters like the ones who accompanied president Franklin D. Roosevelt to Yalta, or like Irene Bruno from the Office of Language Services of the U.S. Department of State who interpreted for president Barack Obama during his visit to Havana in March of 2016.

Diplomatic interpreters are constantly studying and fine tuning their craft. They have great flexibility. On October 23, 2000, Madeleine Albright, U.S. secretary of State under president Bill Clinton, met former North Korean leader Kim Jong Il. Albright had the services of U.S. Department of State Senior Korean interpreter Tong Kim. Albright’s mission was to persuade the regime to abandon its long-range missile program. To prepare, Tong Kim learned arms control jargon, reviewed top-secret briefs, and read a dozen books on nuclear bombs. Kim later stated that he “…kept…reading every article in newspapers and academic journals…” He says that when he began interpreting he “spoke like a South Korean, and they did not seem to appreciate it…” so he perfected a North Korean accent and dialect: “I picked up their language, their intonation, their dialect…and that gives them some trust…” (National Public Radio NPR (https://www.npr.org/2018/06/11/611734103/the-pressure-of-being-an-interpreter-at-a-high-stakes-summit)

Due to the nature of the task, these interpreters often work alone and for many hours. Although team interpreting may be feasible for the conference work in the booth (usually a press conference where the second interpreter may not need to have the same level of security clearance, even though they usually do) long consecutive and chuchotage are generally performed by the same interpreter throughout the encounter. This requires that diplomatic interpreters have great stamina and good health. An important point because it takes many years of practice and study to reach this professional level, therefore many diplomatic interpreters are not very young.  Add the stress factor, generally present in these events because of the importance of the issues being negotiated, the bilinguals in the room who may think they have a better way to say something, and the constant feeling that if something goes wrong, interpreters could be blamed, even if the mishap was not entirely their fault.

Diplomatic interpreters develop an important working relationship with their source. This relationship takes many shapes and forms; sometimes the source is quite detached, and other times they rely on the interpreter for more than interpreting. We are their cultural advisors and sometimes their local history and geography consultants. For example, Harry Obst, who interpreted for seven U.S. presidents during his career, and was the head of the U.S. Department of State Office of Language Services, recalls how President Lyndon Johnson, who ascended to the presidency suddenly when president John Kennedy was killed, was eager to tap interpreters’ wisdom: “…Johnson would caucus with me before the meeting, and he would say, ‘Look, do you know this person? What is he like? Is he devious? Is he straightforward? It is best to raise a subject straight on or fish around it a bit?’” (Harry Obst. “White House Interpreter: The Art of Interpretation”. During the Trump-Putin meeting in Helsinki we could see the different relationship that each president has with his interpreter, while president Trump’s interpreter, Marina Gross from the Office of Language Services of the U.S. Department of State, sat on the chair already positioned for her a few feet to the right of the president, president Putin’s interpreter walked on stage, grabbed his chair and put it next to Putin, just a few inches away.

Sometimes diplomatic interpreters working under such pressure make a mistake; they are humans. During a discussion on an open skies proposal between the 41 president of the United states, George H.W. Bush, and Soviet leader Mikhail Gorbachev in 1990, Soviet interpreter Igor Korchilov said the word “verifying” in English, instead of the correct term “verified”. Everybody in the White House Cabinet Room looked at him, including Gorbachev who quickly said: “No, no. I never said that…” On an interview with National Public Radio (NPR) in the United States, Korchilov remarked: “…To this day, I still feel extremely embarrassed…” On his memoir, Korchilov wrote: “…At the moment I wished the earth could swallow me up…” He then addressed president Bush to apologize, and the American president replied: “…Relax, the good news is that you didn’t start World War III…” He then apologized to Gorbachev who said something all interpreters need to remember: “…Oh, don’t worry, Igor. Only those who do nothing make no mistakes…” (Korchilov Igor, “Translating History: 30 Years on the Front Lines of Diplomacy with a Top Russian Interpreter).

Igor Korchilov made a mistake, but he was a great interpreter who worked as Gorbachev’s interpreter from 1987 to 1990.

Great interpreters make mistakes like everyone else, they just make them on a world stage and everybody finds out, as it happened in the well-publicized case of the joint press conference of U.S. president Barack Obama and king Felipe VI of Spain at the Oval Office in 2015. At the time, Spain was facing an independence vote in Catalonia that could end up in a political and economic crisis for the kingdom. On his remarks, president Obama stated that the United States wanted a relationship with a strong and united Spain (“una España fuerte y unificada”) but the interpreter’s rendition was: “a stronger and united relationship with Spain” (“una relación [cada vez] más fuerte y unida [con España]”) (“El Mundo”. Sept. 2015. http://www.elmundo.es./enredados/2015/09/16/55f9477022601da52a8b45a0.html ) The king, who studied in Georgetown University and speaks English, immediately looked at his delegation and made sure that the Spanish press got the correct presidential statement and not the mistake. Moreover, since interpreter renditions into the foreign language (in this case Spanish) are not shown on American media where they broadcast the president’s remarks in English, nobody noticed the mistake on the American media, but it was big news all over Spain. Once again, this interpreter had faced tougher situations many times.

I hope this gives you all a better idea of what diplomatic interpreters do, who they are, and how they work. I leave you with a quote from David Bernet and Christian Beetz press release for their documentary “The Whisperers”:

A promise to the Iraqi interpreters.

Dear Colleagues:

September 11, 2001 changed the lives of everybody in the United States and in many ways it also changed the way so many live around the world. After the despicable attack on the American people, the U.S. embarked on two armed conflicts in a land thousands of miles away from America, and in so many ways different from the west.

Many young Americans were sent to the Middle East to fight these wars in Afghanistan and Iraq. Most of them were brave service men and women unfamiliar with the geography, culture, traditions, and languages spoken over there.  It became apparent that communicating in the local languages would be essential to the success of the military operations and to the safety of all Americans, military and civilian, in harm’s way. It was then that the United States armed forces recruited native speakers from the local population who spoke English, and were familiar with the culture and social structure of local tribes and governments, friend or foe.

Soon, these brave volunteers from Afghanistan and Iraq learned basic military skills and protocol, acquired the necessary knowledge to serve as a communication conduit between the Americans and the local dwellers, captured prisoners, and members of the official armed forces of Iraq and Afghanistan; they became the conflict zone interpreters of the United States Armed Forces. Many of them were motivated by their resentment towards the local governments and the corruption of their local officials, others did it out of hope for a new regime without religious persecution; some participated because of their sincere admiration for the United States and its values.  All made the commitment to serve as interpreters for the Americans despite the fact that they well knew that they were risking their own lives and those of their family members.

In exchange for these invaluable and much needed services, the American government promised these interpreters that at the end of the conflict, those who were alive, and their families, would be taken to the United States to start a new life away from any potential risk they may encounter in their home countries as a result of their cooperation with the U.S. during the war. This was an essential part of the agreement. These conflict zone interpreters knew that their heads would have a price once they started working for the Americans. They understood that they were not just risking their lives during the fire exchanges or door-to-door raids; they knew that if left behind by the United States, they would be subjected to unspeakable harm by those who considered them traitors. These interpreters and their families would be killed without a doubt.

When it was time to honor their end of the bargain, these brave interpreters fulfilled their promise by acting as communication liaisons and cultural advisors, to the Americans they were embedded with. They interpreted under the most extreme conditions: in the middle of a fire exchange, during unpleasant interrogatories, when helicopters were flying over their heads making it next to impossible to hear what a soldier or an enemy were saying, and while they were running for cover.

Once the U.S. decided to withdraw from the region, the surviving conflict zone interpreters expected the United States government to fulfill its end of the bargain and take them and their families to the United States. They had risked it all honoring their commitment to interpret from Dari, Pashto, Arabic, Kurdish, Syriac, Armenian, Turkmen, Hazaragi, Uzbek, Balochi, Pashayi, and others languages, into English and vice versa.  Now they waited for Washington to live up to its promises and protect them from the animosity and rancor that permeated their towns and villages.

The U.S. government slowly responded and started the immigration process for these born-abroad American heroes. Unfortunately, and to the dismay of the conflict zone interpreters, the men and women in the military they had helped and protected during the wars, and the international interpreter community, the process came ever so slowly. The entry visas were granted at a piecemeal pace. In fact, to this day, many of these interpreters and their families remain abroad, waiting for their entry visas, and worrying about the violence that constantly surrounds them back home.

Despite the efforts of many professional interpreter organizations and other non-governmental entities demanding that immigration authorities speed up the process, many of these conflict zone interpreters and their relatives have lost their lives during this wait.  It is important to mention that the United States government is not the only one delaying the issuance of these entry visas; regretfully, most western governments are doing exactly the same.

I have been fortunate to meet several conflict zone interpreters, and I am honored that some of them call me their friend. They are regular people. They have interpreting stories they like to share just like you, and they have tales of horror that leave you speechless after you hear them. Tales of fathers killed right before their eyes, older brothers recruited for the army against their will in the middle of the night, mothers and sisters raped in their presence, friends and relatives they never saw again. They went through so much, and yet they are kind, friendly people full of gratitude to the United States for bringing them to a safe place.

It is in the middle of this environment that President Trump’s executive order requiring “extreme vetting” before allowing entry to citizens of several countries becomes enforceable on January 28, 2017. Immigration officers inspecting foreigners arriving at all ports of entry to the United States are ordered to deny entry to all people from seven countries: Iran, Syria, Sudan, Libya, Yemen, Somalia, and Iraq. The ban includes those individuals who present a visa to the immigration authority, and even those who have been adjudicated status as lawful permanent residents of the United States.  Tragically, the executive order includes all Iraqis without any distinction; among them: all Iraqi conflict zone interpreters who were entering or reentering the country (certain individuals were excluded from this order for national interest reasons, but that is irrelevant to this post). To add insult to injury, the first Iraqi denied entry to the country at JFK International Airport in New York City was a conflict zone interpreter: Hameed Jhalid Darweesh!

What happened to the promised made to our Iraqi colleagues a decade and a half ago? They fulfilled their commitment to the United States, are we not?

Dear friends and colleagues, President Trump’s executive order covers many issues and has many consequences in the real world. As expected, it was challenged in federal court, and like all lawyers knew, the court granted a stay pending a hearing on the merits in February. I understand that many of you oppose the executive order in its entirety; I am also aware that many of you support it. This is not the place to attack or defend these different points of view. As a lawyer, I believe that some of its content will be overturned and some will be upheld by the courts. Those of you in favor or against the order will no doubt pursue different means to make your voice heard. What I ask you on this entry is non-partisan:  We must protect our profession, we have to support our conflict zone interpreter colleagues.

Please understand that the stay ordered on Saturday by Judge Ann Donnelly is temporary. Do not believe news reports, like Yahoo News, that immediately informed that the president had lost. That is false. What the judge did this time happens very often in cases when the potential damage caused by a government act could be serious and irreparable.  The court has to hear the case on its merits and then decide. This will happen next month, and at that time, she may decide that the government is right, that the government was wrong, or most likely, that part of the executive order is constitutional and part of it is not. Even in the event that the judge rules the order unconstitutional, the Administration will appeal the decision. I have no doubt that this case will end up before the United States Supreme Court.

This is too much of a risk. We have to defend our profession. We have to make sure that the promises to our Iraqi conflict zone interpreter colleagues are kept; that the agreement they entered over ten years ago is honored by our government. We have an opportunity to set precedent in our legal system so that it is clear that in the future, those foreign colleagues who cooperate with the United States in other conflict zones, regardless of geographical location, are protected and treated honorably once it is time to come back home.

Regardless of anything else you may do for or against this executive order, I invite you to contact the White House and the Department of Homeland Security and tell them to support an immediate exception to the executive order excluding from the ban all conflict zone interpreters and their families. Explain to them that they risked their lives for the sake of our country, and that the United States promised to protect them and bring them to America. Ask them to keep our promise the same way they kept theirs.  If you live in a State of district where your senators or representatives are Republican, please call both: their local and Washington office to let them know that these colleagues are heroes who fought for the United States and saved the lives of many of their constituents’ sons and daughters by putting their own lives on the line.  We have to do this. We cannot wait for the outcome of a court case that could take a long time and could grant admission to some of this interpreters and exclude others, particularly those who have never entered the U.S.

We have to make sure that the exception to the executive order, and any future legislation, will cover three types of conflict zone interpreters and their families, regardless of their country of origin: (1) Those already admitted to the United States who may reenter the country after a visit abroad; (2) Those already granted a visa to come in who have yet to enter the U.S., and (3) Those colleagues whose application for admission is still pending adjudication or pending a final decision after an appeal or reconsideration of an original denial. They all assisted the members of our armed forces. All of them have to be protected.

I know that some professional associations like AIIC, FIT and IAPTI,  nonprofit organizations like Red T, which  advocates for interpreters in high risk settings, and some interpreter programs like InterpretAmerica will make their voice heard on this issue. That is great; however, nothing gets the attention of a legislator like the voice of their own constituents; this is why you must call, email, or physically go to their local office. Let them know what interpreters do and how crucial is our work. Many of you have spent a lifetime educating attorneys, judges, physicians, nurses, agency managers, event organizers, sound technicians, and many others, so this should come naturally to you.

To conclude, I thank you for supporting our Iraqi colleagues, for defending our profession, and for setting aside your personal political agendas for the cause that we all have in common: The interpreting profession. I now invite you to share with the rest of us your experiences with conflict zone interpreter colleagues, from Iraq or elsewhere, you have met here in the U.S. or abroad if you were serving in the military with any of them. I ask you to please do so without any politically charged arguments for or against the administration, and I ask you to limit your comments to conflict zone interpreters or their family members.

The new government could help interpreters in the U.S.

Dear Colleagues:

“We are sorry, but we will not be needing your services after all. We decided to hire some interpreters from the country of the people attending the conference…”  Does this message sound familiar? How about this: “…They decided not to retain me because they found somebody less expensive in South America.” (It could be Asia, Africa, or Eastern Europe).

Every interpreter in the United States (and other countries) has been part of this situation too many times in their career. The reality is that many agencies and event organizers are trying to save a buck, and with globalization, it is now very easy to hire a team of interpreters in a foreign country, offer to pay them in U.S. dollars (or euros), and bring them to interpret an event in the United States (or Western Europe) for very little money, compared to what professional interpreters typically make in that market. The foreign interpreters may be excellent, good, or bad; most likely, they will not be acquainted with the local culture, geography, current events, humor, and idiomatic expressions of the place where they are going to interpret, but they will save the agency a lot of money. To them, the little money they will get paid, and the second rate accommodations provided by the promoter of the event will be acceptable because they will be earning more money (and in hard currency) than their typical fees in their home market. The result is not good for the American-based interpreters who cannot afford to work for so little just because of the cost of living and doing business in the United States. I believe that it is not the best possible outcome for the audience either because the foreign-based interpreters (even some of the best) will not be able to understand and therefore interpret all the nuances of the speaker’s presentation just because they do not live in the United States.  Every U.S. interpreter has had this experience when working with a colleague who comes from a different culture, and we have also suffered the painful, stressful situations when we do not get a geographic site, local celebrity’s name, or regional expression because we do not live in the country.

The only one who relatively wins in this situation is the agency or event promoter; and I say relatively wins because they will eventually suffer the impact of this culture-deprived renditions.

To complete the sad picture I have just described, we have the case of those “less expensive” video remote interpreters who provide services for events held within the United States from abroad, and the telephonic interpreting services agencies that have moved a big chunk of their business to foreign countries with little overhead, lax legislation, and much lower salaries. The result: a good number of U.S. based experienced conference interpreters, willing to do video remote interpreting for a fee set by the American market, and many telephonic interpreters, including many who are just entering that market often encouraged by the same agencies alien to the profession but part of the “industry”, will lose their jobs or find little work because the bulk of the interpreting services to American clients are now provided from calling centers in Asia and Central America, and quite a few agencies look for video remote conference interpreters abroad without even looking for them in the United States.

This week a new president takes the oath of office in the United States, and a very prominent part of his agenda deals with protecting American jobs. This is where we can take advantage of the current mood in Washington, D.C., and demand that the new government keeps its promises to the interpreters and translators in the United States.

A new tougher immigration policy will benefit U.S. interpreters if we move our chess pieces wisely.  We must demand Congress, The White House, State Department, and Department of Homeland Security to enforce the labor laws of the United States. You see, most foreign interpreters brought by the agencies enter the United States on a tourist/ visitor visa without ever disclosing the fact that they will work in the U.S.

Working with a visitor’s visa is against the law; misrepresenting your purpose to enter the United States is cause for denial of admissibility and in some instances it could be a crime. Agencies that bring foreign interpreters this way are also breaking the law and should be investigated and fined by the federal government. If the law is properly enforced to protect American workers (that is: all of us) the agencies would need to file a work visa petition with an immigration service center, show a business necessity to bring that individual to do the job, demonstrate that there are no United States citizen or lawful permanent resident interpreters in the United States who are willing and able to perform the service the agency needs in exchange for the prevailing wage or fee for that service in that part of the United States. If the petition is approved, the foreign interpreter would need to attend an interview with a consular agent at the U.S. embassy in his country, and demonstrate that he is qualified to do the job, that he will go back to his country after the assignment is over, and that he has no criminal record anywhere in the world, including any past affiliation to terrorist groups or prior immigration violations in the United States such as deportations, overstays, or having worked without legal authority. Only then, and not a minute earlier, these people could enter the U.S. to work as interpreters for that conference. As you can imagine, this takes time, costs money, and often requires of the services of an immigration attorney. You see, dear friends and colleagues, all of a sudden the U.S. based conference interpreter got a lot cheaper than the foreigner, even if the agency needs to pay market fees in America.  This is our chance to end the “interpreter smuggling” that is happening right now in the United States. Of course, this does not cover foreign interpreters who come as part of the team of a foreign diplomat, head of state, dignitary, or celebrity. Those interpreters will enter the country with their client and for a specific mission that requires of them personally based on other characteristics. They will be paid in their home countries for a service that would not be performed by anyone else, American or foreigner. Even though it has been treated as one and the same, it is very different to enter the United States as the interpreter of the president of Argentina, and enter the country to interpret a conference at the Honolulu Convention Center.

The new government advocates a policy that keeps jobs in the States and will likely sanction those businesses who move abroad and try to sell goods and services back to the American consumer. There is no question that all these interpreting agencies that have moved abroad will qualify for sanctions as long as they provide their services to people in the United States. I believe that the fines and the cost of litigation to keep their facilities abroad selling their services in the United States will be more expensive than closing shop in Costa Rica or India and moving the telephonic interpreting center to Arizona or California.

I understand that this entry may not be very popular with many of my friends and colleagues abroad, but I ask you to please pause and examine your market structure so you can strive for better and more professional conditions in your own countries.  I also believe that much of what I say here can be applied, and in fact has already been implemented in some countries. Only when these conditions even up across the markets we will be able to universally enjoy the advantages of globalization.

You see, dear friends and colleagues in the United States, there is plenty we can do to protect the profession and advance our working conditions under the philosophy of the new administration.  I now ask you to share your comments with the rest of us, and I beg you to please limit your participation to the issues subject matter of this blog, and refrain from politically charged comments either for or against the new government.

Immigration interpreters: Show courage, or prepare to die!

Dear Colleagues:

Last week many of our immigration court interpreter colleagues in the United States received written communication from SOSi, the government’s contractor, asking them to accept a new adhesion policy, which would require them to bid as low as possible in order to qualify for continuing sub-contractor status, as immigration court interpreters, after their current contract expires in a few weeks.

This notice, in the form of an ultimatum, required interpreters to provide their lowest possible hourly “rate” bid for the entire period of performance, and would become the sole basis for priority of case assignments in the future.  Moreover, the agency set top possible fees according to language combinations, and indicated that those bidding above said amounts would not be considered.

The maximum fees to be used as point of departure for this dive to the bottom of the barrel are insulting at best.  If you received the communication you saw the proposed maximum amounts, but for those of you who did not, it is important to be aware of the fact that these fees are way below the court interpreting fees set by the other federal courts (Article Three). The communication expressly mentions that SOSi will not honor the full-day or half-day rates policy that all other federal courts observe.  They also decided that travel expenses will be standardized with no room for negotiation, ignoring variations in cost of living, weather impact on travel, and so on. Finally, for obvious corporate reasons such as lack of candidates to be exploited at this time, and keeping up with this “serf-landlord model”, the agency gives interpreters a chance to extend their present fee conditions for a period of 45 days or until the end of January 2017.

The current Article Three federal court interpreter fees are: for a full-day of work $418.00, for the first half of the day: $226.00, for the second half of the day: $192.00, and $59.00 per hour or part thereof when the interpretation goes past 8 hours.

If you consider that the above federal court fees are for interpreters working under better conditions, such as team interpreting, access to court files for preparation, sometimes one or two cases for the day, reimbursement of travel expenses according to cost of living of the place interpreters travel to; and then you compare it to the conditions historically endured by immigration court interpreters: working solo (with bathroom breaks if you are lucky) hostile treatment in many courts, dozens of cases when interpreting Master Hearings, etc., then you come to the natural conclusion that immigration court interpreters should make the same fees as other federal court interpreters, or perhaps even more if working conditions do not improve. We cannot forget the difference in time elapsed before payment either.  As you probably guessed, immigration court interpreters have to wait longer to see their meager paychecks.

I am not going to go back to my conversations with many of you about a year ago when I warned you of future deplorable working conditions with this agency, and many of you assured me that everything was fine, that you had negotiated a better deal than ever before, and that SOSi had realized that interpreters should be treated as professionals. Well, it turns out that I was right, and that all those of you who refused to sign a contract and decided to look for other green pastures did the appropriate thing, broaden their professional horizons, and avoided having to deal with an agency that is so demeaning to all professional interpreters.

Obviously, as I said before, these posts are directed to those real professional court interpreters who are constantly improving their skills and pursuing certification (or qualification for those languages where no certification is available). I have nothing for those who refuse to pursue certification; that avoid continuing education, or argue that immigration court interpreting is so unique that no professional credential can benefit them.

But to those proud professional immigration court interpreters who view their occupation as a professional service and understand the importance of what they do, I invite you to consider this: Another year went by and SOSi continues its path to commoditization of immigration court interpreting; they moved ahead with their plan to transform you into language laborers who will blindly obey any order given without questioning. Their goal is to profit as much as possible (nothing wrong with that) by creating the illusion that they are providing a professional service while in reality delivering sub-standard interpretations without any regard for the consequences on the lives of those directly (respondents) and indirectly (American society at large) involved (this is wrong).

Dear colleagues, this is your last chance to act; by next year the monster will be too big for you.  It is clear that the agency’s goal is to get the cheapest possible “interpreter” available, and to continue to look for a cheaper one. It is also clear that they do not have enough of these language laborers at this time. Thus the reason for them to extend your current contractual terms for another 45 days or so. They need this time to find your replacement, not based in quality, but in bargain price.

As of today, without you they have to close shop. They just cannot provide the service EOIR hired them to do. Understand that you have leverage, keep in mind that by next year, with a more aggressive prosecution of immigration cases under a new White House, EOIR will surely need more interpreters than ever before. It is simple demand and supply. Today you control your destiny.

For this reason, it is important that you act, seize the moment, and protect your dignity. I invite you all to send a message loud and clear to SOSi, EOIR, and the immigration attorneys. Send your bids for a fee not lower than the federal court interpreter fee, and send it for full-day, half-day, and overtime. Tell them that reimbursement of travel expenses will be negotiated on a case by case basis, and do not sign the contract extension. Moreover, send your bids to SOSi, but copy the Executive Office for Immigration Review (EOIR), your local immigration courthouse, and the American Immigration Lawyers Association (AILA). Let them all know that you are professionals providing a critical service to the administration of justice.

Explain that you cannot accept the proposed conditions because of the complexity of what you do. Tell judges and lawyers that a SOSi certification is not a court interpreter certification at all; let them know that Spanish interpreters can obtain a federal court certification, that other languages can get state-level certifications, and that for those languages with no certification program, there are other options to prove your professional qualifications such as college degrees, translator certifications by the American Translators Association (ATA) or a passing grade on the translator or seminary-level interpreter exams by the U.S. Department of State (DOS).

During the last twelve months I learned how many people at EOIR were under the impression that a certification by SOSi was the same as the federal court interpreter certification. I saw the faces of many immigration attorneys when they learned that so many of the interpreters they regularly use in immigration court are not court certified, and I heard many of them telling me that, knowing now of this lack of certification, they understood why they never saw them in any other courthouse.

It would be unfortunate to learn that some of you decided to lower your head and take the extension, or bid according to their unconscionable terms. It would also be a gigantic waste of the greatest opportunity you will ever have to finally professionalize immigration court interpreting. Giving in, or giving up at this time would be the first step to your professional death. Immigration court interpreters, it is time to show courage and determination, or to prepare to die.

Are we protecting our profession? Part 2.

On the first part of this entry we discussed the role that professional associations should play on the face of antitrust legislation and its adverse effect on our profession.  Today we will explore another crucial aspect of the profession that has been under siege for several years; and if some external forces have their way, it could set the profession back to the Stone Age.  I am referring to the very popular tendency to minimize the importance of interpreter and translator professional licenses, certifications or patents and the acceptance, and in some cases even blessing, of lesser quality paraprofessionals as the preferred providers of services by many government entities and multinational interpreting and translation corporations who make the decision to hire these individuals, who are unfit to practice the profession, based to the extremely low fee that they command.

It took interpreters and translators many decades of constant struggle to get to the point that their accreditations became widely known and accepted as the standard of quality among those providing the service.  Finally, holding an American Translators Association certification, or proof of many years of experience,  gave the real professional translator the needed tool to argue that she should get the job over the individual whose only credentials were the translation of his parents’ birth certificates and a couple of elementary school reports.  The days when a real professional interpreter would lose an assignment to a person whose only linguistic experience was that he had lived in two different countries during his life, became less common when true professionals started to demand top assignments with their interpreter degrees, or their court, or healthcare certifications in hand.  There was a lot to be done, but interpreters and translators were on their way to educate more prospective clients and government officials every day.  People began to notice the difference on the quality of the service rendered by a real certified interpreter or translator.

But, since nothing can come to the interpreting and translation world without drama and tragedy, technological developments such as CAT tools and telephone/VR interpreting came to be. This should have been a welcome development that benefited interpreters and translators; however, this new technology, combined with a global economy where big corporations seek profit by bastardizing a real profession and turning it into an assembly line, and changing its name from profession to “industry”, injected a new player to our eternal drama:  the opportunist, also known as the “new talent scout” whose sole function was to undermine established professions, like ours, and replace quality professionals with cheap novice paraprofessionals who see this individuals as their ticket out of the flipping burgers world.

Compounding the problem in the United States, there was a new administration in the White House, whose attorney general was determined to compel the state-level agencies who were recipients of federal funds, to provide access to their services for everybody, regardless of the language they spoke. This in itself sounds very good and fair, and in fact it was not just the right thing to do by the administration, it was long due as this mandate had been part of the law since the mid-sixties when Title VI of the Civil Rights Act was enacted.  In fact, to an interpreter or translator who did not know the reality of the American system this would look like a pot of gold. All of a sudden millions of people who needed interpreting and translation services were going to get them! Unfortunately, reality and a short-sighted government opted for the easy way out, a path that was doomed from the beginning. Let me explain: This instantaneous demand for many more interpreters and translators exceeded by far the supply of professionals in the United States, and to meet the mandate, the states decided to enable just about any almost-bilingual individual, to provide translation and interpreting services, instead of promoting more college programs and encouraging American citizens and permanent residents to prepare themselves, and become true professional interpreter and translators, who would have access to professionally remunerated work due to the implementation of this legislation.

When the opportunists, also known as the “new talent scouts” realized what was going on, they immediately saw the possibility for huge profits by providing the required services with tons of these paraprofessionals, who they immediately hired at rock bottom fees.  Moreover, they saw the possibility of making their margins even bigger by using machine translation and retaining humans as proofreaders, and by providing interpreting services by telephone, and lately by video remote interpreting or VRI in some cases, while hiring these new “type” of “interpreters” by the minute (or if they are lucky by the hour).

Government officials liked the solution, but they still had one more obstacle that was keeping them from going all the way with these multinational corporations operated by the opportunists, also known as the “new talent scouts”, who by now were active in social media, writing their own blogs, and organizing their own conferences to build themselves up like interpreting and translation “self-proclaimed gurus”. That obstacle was the certification.

The certification, that extremely difficult and elusive project that took real interpreters and translators several generations to create, and then make known and widely respected, was by now a requirement in the law.  It was obvious that the new paraprofessionals would never pass a certification exam, so the government officials and their “associates” had to think fast, and cheap.

The solution they came up with was the creation of a “second class” tier of people who they call “language facilitators”, “justice-system interpreters”, and many other labels, avoiding this way the uncomfortable, and perhaps illegal alternative of referring to them as translators or interpreters, who, in lieu of a real certification, would be “accredited”, “registered” and many similar names.  Now they argue that these individuals can provide the professional service as long as the content is not too difficult or the event is not very important!

Finally, to end the vicious circle, some of our opportunistic “friends”, also known as the “new talent scouts”, realized that with government officials willing to do whatever possible to go around the true mandate of Title VI, which would require them to use certified, experienced, professionally trained interpreters and translators, they could get another piece of the pie by pulling a rabbit out of a hat, and creating a mutant creature they would call: “community interpreter certification”.

The principle is very simple: What do you do when you have a group of people who cannot pass the interpreter certification exam? You develop another program with an exam easy enough for anybody to pass, and you propose it to the authorities as a legitimate certification for court cases before administrative judges, for client-attorney interviews, and for simple medical events. Do you see the pattern? Once again we have the not-so serious event and the not-so difficult content rationale to justify the use of mediocre individuals, who have only one advantage over the real professional, experienced, certified interpreters and translators: They will work for peanuts; because whatever they get paid will be better than the money they were making before they got “discovered” by the talent agent.  Never mind the fact that administrative law hearings are as complex as Article Three court hearings as I have indicated on a previous entry to this blog a few months ago.

The situation turned for the worse when the implementation of Title VI at the state-level civil courts in the United States was narrowly interpreted by many of their administrative offices, as meaning that only interpreters supplied through the judiciary could provide services in civil matters. This actually killed the main source of income to many entrepreneurial interpreters who had opted out of the bureaucratic, low-paying criminal court assignments, and had developed their own client-base, charging for their services according to supply and demand. Oftentimes, because of the complexity of civil litigation, and because of their type of clients, these interpreters fared much better than their counterparts who stayed on the criminal court bandwagon.  Title VI guarantees equal access to all government funded services, including the administration of justice, but it does not make it illegal for litigants who want to, and can afford it, to hire private interpreters.  In my opinion, this is a classic example of a situation where professional associations needed to protect their individual members, and the profession, by advocating for the availability of private interpreters to be retained for civil litigation.  Unfortunately, instead of taking action, our biggest professional association in the United States not just sat on the sidelines, but welcomed the new “civil court-provided interpreter system”, and remained silent when some states decided to meet the requirements of Title VI by hiring big “interpreting services” agencies (who view our profession as an industry) to program the interpreters for civil cases.

To summarize the situation, we now have an environment fostered by the government authorities, and exploited by the multinational interpreting and translation corporations, plus some small “local talent” that was able to learn fast how to do this thing, where certifications and education do not matter anymore, where assignments are going to questionable paraprofessionals, many of whom have never been able to pass a certification exam, who are working under terrible conditions, in exchange for a miserable fee.  The first logical reaction of any interpreter or translator should be one of outrage, disgust, frustration. The second reaction should be to talk to its professional association and ask it to represent its members and protect them from these nefarious tendencies, thus saving the integrity of the profession.

Attorney and medical associations are vigilant and protective of their members and profession. They do not allow, under any circumstance that paraprofessionals practice law or medicine. In fact, attorney associations set the standards of practice in their profession. No agency or its equivalent is allowed to set the tone.  They have lobbied for, and achieved legal protection: In the United States it is a crime to practice law without a license, and this applies to all court proceedings, including administrative courts.

Unfortunately, this is not the case with some of the bigger translator and interpreter associations.  They keep silent when the government creates these groups of paraprofessionals to “meet” the requirements of Title VI. They invite those who are turning translators into proof readers to their conferences to recruit more of the young talent before they learn to separate good from evil; Instead of protesting, criticizing and denouncing the birth of that Frankenstein’s monster called “community interpreting certification”, they celebrate the lowering of the bar and open wide their organizations’ doors for these paraprofessionals.

Moreover, they welcome as their members many of these multinational corporations, “self-proclaimed” gurus, and opportunists, also known as the “new talent scouts”. Maybe they do so because they do not know of all these terrible things that are happening to the profession. Maybe they let them in because they share their view of interpreting and translation not as the professions they always were, but as industries where the proofreader (formerly known as translator) and the part-time telephone operator (formerly known as interpreter) will happily hold hands at the assembly line and praise the virtues of the big “language” corporations. The question is, what are professional associations for? The U.S. Presidents and First Ladies who spoke a foreign language.

Dear colleagues:

In a few days Americans will observe Presidents Day, so I thought this would be a good opportunity to talk about those American Presidents, and their spouses, who spoke more than one language. It is common knowledge around the world that many Americans do not speak a foreign language, yet, almost half of the forty four men who have been President of the United States spoke, or at least had some knowledge of a language other than English.

Much of what we know about Presidents’ and First Ladies’ fluency in foreign languages came to us through testimonials and documents, and not all of it is undisputed. There is no doubt that Thomas Jefferson spoke fluent French, but his claim that he could speak Spanish seems unlikely. According to a documented conversation he had with John Quincy Adams, Jefferson said that he had learned Spanish in 19 days while sailing from the United States. He probably understood and read some Spanish (He used to say that he had read Don Quixote in Spanish) but that did not make him fluent.

At the beginning of the United States the White House was occupied by many intelligent men who enjoyed reading and learning. In those days many intellectuals learned to read in foreign languages in order to have access to certain scientific and literary works. This probably was the level of expertise that many of the Presidents had. Thomas Jefferson spoke French, and he could read and perhaps write and speak some Greek, Latin, Italian and Spanish.

President John Adams lived in France and became fluent in French. He could also read and write some Latin. His son, President John Quincy Adams spoke French very well, and had a decent Dutch as he went to school in The Netherlands and his wife spoke it. As an adult he learned some German when he was Ambassador to Prussia, and he also read and wrote some Greek and Latin. President James Madison also wrote and read in Greek and Latin, and his Hebrew was fairly decent.

President James Monroe and his entire family spoke excellent French, and it was common to hear the entire family having their conversations in French. President Van Buren was born in New York, but his first language was Dutch. He learned English later in life as part of his education. He also learned some Latin when he was studying English. Presidents Tyler, Harrison, Polk, Buchanan, Hayes, Garfield, and Arthur knew how to read and write Latin, Greek, or both.

Despite having a “German-like” accent, President Theodore Roosevelt had an almost fluent French (He confessed that verb conjugation and gender were not his strong points) and he spoke some German. President Woodrow Wilson learned German in college but was never fluent. On the other hand, President and Mrs. Hoover were fluent in Mandarin Chinese. President Franklin D. Roosevelt spoke German and French. He also studied some Latin.

Presidents Jimmy Carter and Bill Clinton speak some Spanish and German respectively, but neither one of them can be considered as fluent. President George W. Bush speaks some Spanish and because of his years in Texas, next to the Mexican border, he understands even more. As far as President Obama, it has been said that he has a little understanding of Bahasa Indonesia.

There are a few First Ladies who could speak a foreign language. The first one that comes to mind is Elizabeth Monroe, spouse of James Monroe who spoke French with fluency. John Quincy Adams’ wife, Louisa, was the only First Lady born in a foreign country (England). She spoke good Dutch.   Grace Coolidge, wife of President Calvin Coolidge, worked as a teacher of deaf students, and was the first lady who knew American Sign Language).

Herbert Hoover’s wife, Lou Hoover, was the first woman to graduate from Stanford University with a geology degree. She also spoke Mandarin Chinese fluently. Jacqueline Kennedy lived in France and spoke very good French. She also knew some Spanish. Finally, Pat Nixon, President Richard Nixon’s wife, spoke some functional Spanish.

Now you know, or perhaps confirmed or debunked a prior understanding about the foreign languages spoken by America’s First Families. I understand that this post is probably too generous about the proficiency level of some of our Presidents and First Ladies, and when we compare them to the extensive knowledge of foreign languages that other Presidents and Heads of State have, we are probably far from the top of the list; however, some of our First Families were really fluent and we should acknowledge them here. The American Founding Fathers and their Foreign Languages.

Dear Colleagues,

On this Fourth of July all Americans celebrate our independence.  We know that on this day we recognize the immense wisdom and unlimited courage of a group of men who lived in the same right place at the same right time.  Although most of us will spend the better part of the day watching baseball, having a hot dog, and attending some local fireworks tonight, I thought that this year it would be interesting to once again talk about a little known aspect of the founding fathers’ lives: Their knowledge of foreign languages.

It is undisputable that they were all bright, well-educated, and visionary heroes who crafted an idea and implemented a concept never attempted before: a country with no monarch where the people were in charge.  We have read about their political, diplomatic, scientific, and military qualities, about how gifted they were. It is time to review their knowledge of foreign languages.  George Washington did not speak any other language. No doubt because of his very little formal education and humble beginnings he just spoke English.  Abraham Lincoln would fit the same bill. The emancipator was a self-educated attorney with a very modest upbringing and he never learned any foreign languages either. These two American heroes did not travel abroad in their lifetime.

Thomas Jefferson, author of the Declaration of Independence, first Secretary of State under Washington, and our third President spoke English, French, Italian, Latin, and he could read Greek, and Spanish. Benjamin Franklin, America’s first diplomat and well-known genius spoke English, French and Italian.   Our second President: John Adams spoke English, French and Latin. President James Madison spoke English, Greek, Latin and Hebrew.  James Monroe spoke English and French.

Although Samuel Adams and John Hancock did not speak any foreign languages, Hancock, the wealthiest of our founding fathers, and perhaps the most generous, founded a Professorship of Oriental Languages and Hebrew in Massachusetts.  All in all, 21 of America’s 44 Presidents have known at least a second language, and if you consider that America’s first Nobel Peace Prize recipient: President Teddy Roosevelt spoke French and German,  then we can say that two out of four Presidents sculpted on Mount Rushmore spoke a foreign language.

This may not be the most relevant aspect of a hero’s life, but it is a good way for a linguist to wish all of my friends and colleagues, together with their families, a happy Fourth of July!
