Do many interpreters experience vicarious trauma?

Dear Colleagues:

I ask this question because I have been an interpreter for over 30 years and I have experienced no symptoms of vicarious trauma. When I started my career, nobody ever talked about vicarious trauma whether by its name or by any other name; however, in the last few years I have read many articles and attended many interpreter conferences where some of my colleagues dealt with this issue. I did my homework before writing this post. I read about the symptoms and activities that, as interpreters, put us at a higher risk because of the exposure to people or situations involving suffering, injustice, and many terrible things.  I read about empathy, compassion, internalizing your feelings, emptiness, denial, coping with big world tragedies through psychic numbing, and even sociopathy (antisocial personality disorder) and discover that none apply.

I consider myself “normal”. My friends see me as a regular guy. I am kind and considerate to those around me; I am a happy guy, and I have been told that I am a good friend, relative, and colleague. I will never be nominated for the Nobel Peace Prize, but I have a full life doing what I like with those I care for.

After much consideration, I concluded that my attitude towards my profession has kept me from vicarious trauma. My background is in Law. I was an attorney before I was an interpreter. During the years I practiced my former profession, I was exposed to many bad things. I got to see the dark side of human nature. Then, my interpreting career began in the courtroom. I now work as a conference interpreter, and I have never worked as a healthcare interpreter, but I spent my days in courthouses and jails for many years. Both occupations put me in the middle of murders, rapes, drug crimes, child molestation, ugly divorces, loss of parental rights, domestic violence, wrongful dead, bankruptcies, deportations, and similar situations. For years I interacted with people: defendants, plaintiffs, witnesses, and victims, providing my professional services on what had to be the worst day of their lives. People do not get up in the morning and say: “I think I would love to be arrested today”; or “today is a good day to terminate my parent-child relationship forever”. Unless they go to get married or to adopt a child, regular humans do not go to courthouses just because.

I have worked side by side with many interpreters during trials involving vicious criminals and people found not guilty by a jury. I have interpreted testimony of children graphically describing sexual crimes committed against them, and have interpreted when a mother described to the jury how the bad guys killed her son in front of her.

I have sat next to individuals charged with murder and facing the dead penalty, and with parents of young children who know they will be deported on that day. During those hundreds of cases throughout several decades, I never heard a fellow interpreter say they were feeling the symptoms of vicarious trauma. I now wonder if they, like I, experienced none of them, they did not recognize them, or they were just hiding them.

I think that I have never suffered the effects of this trauma because, even though I cry at the movies, I have always focused on the task and delivered the service, always knowing these were cases, not my personal life. I have always treated the client with respect, addressing them by their name and accommodating their professional interpreting needs regardless of the charges they were facing. To me, a murder trial is never about the gross details of the killing. It is about the theory of the defense, the prosecutorial strategy, the skill needed to get certain evidence admitted to trial. It is never about the small kid telling the judge who he rather be with: his father or mother; it is about delivering the rendition with the proper register, hearing everything that child is mumbling from the stand, staying out of the judge’s field of vision so she can better evaluate the witness’ testimony. I have never injected myself into a case or the personal life of the parties. Unlike most of my colleagues, after a rendition, I remember the legal arguments in a motions hearing much better than the testimony of an eyewitness. When I do legal interpreting without ever thinking about it, I have always seen myself as a person looking through a window, a spectator, a professional doing his job. I never identify my life or feelings with those of the parties in a case. I act professionally around those I interpret for, but I have never held a conversation with them; not even small talk beyond inquiring their place of origin so I can hear their accent and know what to expect. I never asked them if they want a glass of water. I never ask them if they have questions. Those are things for their lawyer or the Marshall to ask. When they occasionally ask me to convey a message to a relative in the courtroom, I simply tell them I cannot. It is not part of my job. Except for the names of those who I first interpreted for many years ago, unless my client was a celebrity for the right or for the wrong reasons, I never even remember their names or faces.

I never planned it; this is how it always was. This is how it always will be. Therefore, when I leave the courtroom after the convicted felon has been sentenced to life, after I interpret the deportation order, or when I hear the still doors closing behind me as I leave a prison, I go home, meet friends for happy hour, or catch a baseball game at Wrigley Field without ever thinking about the things that took place at work. I close the drapes of that window.

The question at the beginning of this post is real: Have you experienced vicarious trauma? I am sure some of you have, but I would like to know if I am in the minority or not. Please share your experience; I would love to hear from you. It is fine if you just want to tell us yes or no. The last thing I want is for you to bring back your bad memories again.

Interpreting CJA cases is a bad business decision.

Dear colleagues:

A recurring theme among my court interpreter colleagues in the United States is the extreme difficulties they must endure when working under the Criminal Justice Act program (CJA). There are complaints about absurd paperwork procedures and unimaginable payment delays. Some colleagues’ invoices for professional services rendered under this program have been outstanding for over a year!

I worked with attorneys under the CJA program, but when the system changed about 18 months ago, and interpreters’ invoices had to go through the defense attorneys to get paid, and I heard some of the delayed payment stories from colleagues nationwide, I decided not to take CJA cases anymore.

For those of you who do not do federal court interpreting work in the United States, in 1964 the United States Congress enacted the Criminal Justice Act (18 U.S.C. § 3006A) to provide a system for appointing and compensating lawyers to represent defendants financially unable to retain counsel; and providing for payment of experts, investigators, or other needed defense services in federal criminal proceedings, including interpreters. Today, the Office of the Federal Public Defender, with the over 10,000 private “panel attorneys” who accept CJA assignments annually, represent the vast majority of individuals prosecuted in U.S. federal courts.

CJA panel attorneys are paid an hourly rate of $132 in non-capital cases, and, in capital cases, a maximum hourly rate of $185. These rates include both attorney compensation and office overhead. In addition, there are case maximums that limit total panel attorney compensation for categories of representation (for example, $10,000 for felonies, $2,900 for misdemeanors, and $7,200 for appeals). These maximums may be exceeded when higher amounts are certified by the district judge, or circuit judge if the representation is at the court of appeals, as necessary to provide fair compensation and the chief judge of the circuit approves.  CJA attorney appointments are made by the Court on a rotating basis among members of the panel. Freelance federal court interpreters are paid with the same system, but with an additional step: Before their invoice goes to the judiciary, it must be reviewed and approved by the CJA panel attorney who requested the interpreter’s services. I guess interpreters are officers of the court of a lower tier, so they must be policed by the CJA panel attorney, apparently an officer of the court of a tier higher than the interpreter.

This process, not required when interpreters work directly for the federal courts interpreting court hearings or out-of-court interviews for public defenders or probation officers, created a burden on freelance interpreters who now devote a considerable, uncompensated time to the paperwork and its unavoidable eternal follow up process, that often takes many months and even years. Interpreters are billing for the time they worked as interpreters in a case, but that time represents but a fraction of the hours interpreters spend on paperwork, and follow up telephone calls, emails, and in-person visits to the courthouse, trying to discover the status of a payment for a service provided long before. This time goes uncompensated, and interpreters cannot work somewhere else, and generate income, while they are tied up in bureaucratic nonsense and begging for payment of rightfully earned professional fees.  For all these reasons, and to keep my health, sanity, and dignity, as soon as the system started I decided not to take any CJA panel cases, and I have taken none.

I suggest you do the same. Once you do it, you will be surprised at the money you will save just by rejecting these cases. Those of you who know me, or have read this blog for years, know that I am always suggesting diversification in the profession among freelancers so you can keep steady income, and a stream of interesting assignments instead of a boring monotonous routine. Dear colleagues, there are plenty of options even if court and legal interpreting is your thing and you do not want to step outside your field.

The most desirable practice would be civil cases with well-established high-profile law firms. They generally handle interesting cases, have clients who understand and appreciate your work as interpreter, and pay excellent, professional fees when you negotiate correctly. Smaller civil law firms and solo practitioners are also a good alternative.

Next, you have the criminal defense private attorneys. They have time to handle their cases and they usually retain you for the entire case. Here your interpreting services are well paid, and you are exposed to challenging, but interesting cases. It is rare to work in a case involving white collar crimes when you spend your time providing services to public defenders and CJA panel attorneys.

Foreign law firms are also a very good choice. Globalization has generated a big multinational litigation practice, and those top-notch attorneys coming from countries where they do not speak English may need the services of a local court interpreter team. Fascinating topics, including intellectual property, foreign trade, mining, hazardous materials, are common with these clients. Family Law practitioners from these countries are also looking for interpreting services in cases of divorce, child support, international child abduction, and others.

If you want to fill in the rest of your agenda with more court/legal work, you can also provide interpreting services to the Office of the United States Attorney in your jurisdiction. Witness preparation, proffers, transcriptions, and other services are required by the AUSA. An added benefit: They are not bound by the (every-day lower) federal fees, so you can negotiate a much better compensation for your professional services.

If you like working with the federal prosecutors, then you must offer your services to the United States Trustee Program (USTP) for their exams and interviews in federal bankruptcy court cases. This is another source of legal/court interpreter income that pays well when you negotiate your fee correctly.

Finally, you can still work with the federal public defender and, if you want to interpret hearings instead of interviews, negotiations, and depositions, you can interpret for the federal courts. You will only make the set half –a-day or full-day fee, and you will usually get the same type of cases, but you will stay away from the long, demeaning, and never-ending invoice procedures associated with CJA panel attorney cases. As a less desirable option, but in many ways better than dealing with the CJA system, you could always work at the state-court level.

Dear friends and colleagues, there are plenty of alternatives to CJA assignments, even within the court/legal field. I believe that if you all were to do what I did from the beginning, the CJA system would have no choice but to change and become more interpreter-friendly. I do not believe on “fantasyland solutions” such as talking to chief judges and court clerks; it was tried in some districts and they accomplished nothing. We cannot continue to lose income, health, and dignity backing up a system that proved ineffective. I now ask you to share your comments with the rest of us.

U.S. Immigration Court interpreters’ other enemy.

Dear Colleagues:

About two months ago the California immigration court interpreters started a movement to force the hand of SOSi and the EOIR with the goal of achieving better work conditions, a professional pay for the services rendered, and to keep the authorities from hiring new interpreters and interpretation students for a lower fee.  This entry will not deal with the merits or the outcome of such movement. We will talk about the elephant in the room: the big obstacle to the professionalization of the interpreting services in American immigration courts that can be changed by the interpreters themselves.

I know that this blog entry will make some uncomfortable, and I do not like to do that. Unfortunately, my life-long effort to fight for the professionalization of interpreting does not allow me to keep silent. To me, that would be equivalent to betraying my own professional standards. I write this piece with respect and with no desire to offend, knowing that by the time some of you finish reading this article, you will feel offended. I only ask you to reflect on what bothered you, and honestly acknowledge, at least to yourself, that you are not really up to save the profession (as a true profession, not as a laborer’s occupation) in the immigration court arena.

For several years now, there has been a tendency to credentialize interpreters who provide services to the public, who perform a fiduciary function.  Because of the wide variety of languages regularly spoken in the United States, and due to the millions of people who do not speak English at all, or at least good enough to go through a legal or medical process, most efforts have been applied to the certification of Spanish interpreters, by far the most popular foreign language nationwide, and finding other solutions for the other languages.

Court interpreters had an early start and developed the federal Spanish court interpreter certification exam. Many States followed and the States’ Consortium for State Court Interpreter Certification was born, later taking us to the current Language Access Advisory Committee (LAAC) and Council of Language Access Coordinators (CLAC).

Healthcare interpreters followed suit and developed two different interpreter certification programs (the Certification Commission for Healthcare Interpreters: CCHI, and the National Board of Certification for Medical Interpreters’ CMI program) both of them widely spread and recognized throughout the United States. Granted, the term “medical interpreter” to describe the functions of these professionals is less accurate that “healthcare interpreter”, and compared to the court interpreter certification federal and state-level exams, both healthcare certifications are way behind in content and degree of difficulty; but unlike court interpreter certification programs, healthcare interpreters have achieved something extremely valuable that court interpreters can only dream of: an examination administered by an independent entity, just like lawyers and physicians, instead of the uncomfortable government-run court interpreter programs that always raise the issue of the real conflict of interests when the entity certifying interpreters is the same one who hires them.

At any rate, healthcare interpreters in the United States now have a way to prove that they are minimally qualified to do their job, that they adhere to a code of ethics, and that they comply with continuing education requirements that will keep them current in language, interpreting, terminology, and medical issues. In other words, healthcare interpreters sitting at the table with court interpreters can now bring up their credential and feel at the same professional level than their legal colleagues, instead of having to give a speech about how certifications do not mean a thing, that it is working in the trenches that makes you a good interpreter, and that your field is so unique that no existing certification exam could test what is needed to work in that field.

Well, dear friends and colleagues, this takes me straight to a very real, and somewhat uncomfortable problem, faced everyday by immigration court interpreters in the United Stets: They have no certification program requirement to work in court, and for that reason, there is no way to prove a certain minimum level, thus allowing bad interpreters to work in the immigration court system for years.

Court interpreting is a highly skilled occupation that requires of a professional provider. By its nature, it is also a fiduciary function where a judge, attorneys, respondents and witnesses must trust the knowledge and skill of the interpreter who will speak throughout the proceedings while at least half of those present will not understand a word of what was said. It is an awesome responsibility that cannot be left to the paraprofessional or the untested.

Presently, all Article Three courts in the United States, at all levels (federal and state) have a Spanish language court interpreter certification program that includes minimum requirements to take the exam, passing a comprehensive and difficult test (at least at the federal level), observing a code of ethics, and (with the exception of the federal program) complying with continuing education in the legal, interpreting, and language fields to be able to keep the certification. These courts are part of the Judiciary Branch of government.

Immigration Courts are not a part of the Judiciary. They are in the Executive Branch of government and are referred to as Article One courts because of their legal basis in the U.S. Constitution. The thing is, my colleagues, these courts deal with societal, family, and personal values and interests as important as those heard by Article Three judges. They are courts of law that abide by a set of substantive and adjective laws.  For practical reasons, they operate just like any judicial court: there is a judge, there are parties (one of them will be the government just like in criminal law), there are witnesses, and there are attorneys.  Although the controversies are different, immigration proceedings also include a first appearance, motions hearings, a court trial, and a verdict. There is a burden of proof, rules of evidence and procedure, and the possibility of an appeal to a higher court (Board of Immigration Appeals). The fact that the terminology calls these hearings “master calendar”, “bond redetermination”, “credible fear”, or “individual hearing” does not make much difference.   The cases are as different from those interpreted in an Article Three courtroom, as a criminal case differs from a civil or a family law proceeding.

The skills required to interpret are the same as in any other type of court proceeding: There is a need for simultaneous and consecutive interpreting, as well as sight translation. Interpreters use equipment just the same (in fact, in many cases even the same brand), and the expected ethical and professional conduct of the interpreter is the same.

It is a fact that immigration court interpreters are disrespected by their client: the EOIR on a daily basis. There is no denial that they make little money, work long hours, and they do it solo, regardless of the complexity or duration of a hearing. It is also well-known that they are treated in humiliating fashion by being forced to jump through many administrative hoops that no other court interpreter will ever face, in part because they are subcontracted by a multinational agency that tries to keep control over the interpreters without physically being at the courthouse, but also in part because interpreters are not considered professionals, they are not acknowledged as officers of the court.

I firmly believe that the only way to earn the credibility they need so much, Spanish language (for now, and ideally all widely used language combinations later) immigration court interpreters in the United States must demand a court interpreter certification requirement to be able to work.  They need it for their credibility among their peers and with the public opinion.  Once they have a credential, together with a code of ethics and continuing education requirements, they will be in a much better position to negotiate with anybody.

Because immigration court is a federal matter, and the services provided by the interpreter are the same as the ones in all federal courts, I think that the certification they need to have is the already existing FCICE. It would be very simple, all they need to do is convince the EOIR of this need. The exam already exists, all these interpreters would need to do is register and take the test. Then, if both, EOIR and the immigration interpreter community think it is appropriate, there could be a short immigration terminology exam (although I don’t think it necessary just like current certified court interpreters do not need to test every time they interpret a different kind of hearing. Part of an interpreter’s duty is to get ready for an assignment and that professional obligation should be enough).  This would be the best way to demonstrate that their simultaneous, consecutive, and sight skills are at a minimum level to deserve that trust we discussed above. In fact, by getting EOIR to agree, immigration interpreters would have until the Summer of 2018 to take and pass the written portion of the federal exam, and then until the Summer of 2019 to take and pass the oral test. In the meantime, it could be agreed that those currently working would continue to do so until the Summer of 2018.

This solution would immediate put immigration court interpreters at the same negotiating level as their Article Three federal counterparts; In fact, it would benefit everyone: Currently federally certified Spanish court interpreters would consider working in immigration court as the pay would be the same (or almost), and newly federally certified immigration court interpreters would have the opportunity to broaden their professional horizons and work in federal courts.

Of course, this means that two things must happen: First, the certification exam cannot be a “Mickey Mouse test” like the ones offered to immigration court interpreters by multinational agency contractors; they have no scientific value and a very poor reputation. And second, immigration court interpreters need to understand that those who do not pass the exam must go, regardless of the time they have been a fixture at the immigration courthouse. Any other “solution” would defeat the purpose and discredit the credential. This, my friends, is the “other” enemy of the U.S. immigration interpreter: the bad interpreter who has never been able to pass a court certification exam, knows that they never will, and spend all their time and energy trying to convince others that certifications are worthless, exams are rigged, and that the only way to learn the profession in in the courtroom.  These people have to go away. They are like a cancer that is slowing down the progress of the rest of their colleagues.

To argue “unity” to protect and keep these individuals is misleading. Professional unity can only happen among professionals, and the individuals I just described above may be paraprofessionals but they are definitely not professional material. Imagine for one moment going to the hospital for emergency surgery and being told that the person who will operate on you has never taken or passed the Board, but has a lot of experience. Would you let this non-doctor cut you open?

I understand it is very hard to set aside our emotions and empathy for these individuals, but it is time to think of yourselves, your families and your peers. Unless you want to continue to struggle as an immigration court interpreter, you have to get certified. A decision to dodge the certification issue, or to settle for a lower standard of certification, because someone who cannot pass the test convinced you to support other options, will be a vote for the status quo, sacrificing the good ones to protect those who do not deserve to be there.

U.S. immigration interpreters under siege again.

Dear Colleagues:

It is not common that I write a blog entry hoping to be wrong, but on this occasion I hope I am mistaken. Let me explain:

2015 was a very difficult year for our immigration court interpreters in the United States. After decades of working with the same agency, the Executive Office for Immigration Review (EOIR) granted their court interpreting services contract to a new contractor that is better known for their multi-million dollar contracts with the United States Department of Defense than for their interpreting services.  This new contractor: SOSi, won the licitation process by bidding lower than anybody else, and to keep the operation profitable for their stakeholders, they attempted to hire inexperienced interpreters and pay them extremely low fees under unimaginable work conditions.

The interpreters rallied against the newcomer’s offer, united like never before, and took to the social media, traditional media, and professional associations for support. The movement became quite strong and as a result of these actions by our immigration court colleagues and their allies, SOSi was left with no choice but to offer contracts to many of the more experienced interpreters under work conditions similar to the ones they were used to with the former contractor, and in many cases with the interpreters getting better fees than before. SOSi agreed to these terms and addressed some of the main concerns that the EOIR had about the way they were to offer interpreting services nationwide by hiring some of the support staff that had previously worked for the previous contractor: LionBridge.

At the time, it looked like SOSi got it and decided to do things the right way; unfortunately, their temporary contract with the United States Department of Justice was about to expire and they had to move quickly to turn that provisional contract into a permanent contractual obligation. To achieve their goals, once that interpreters, immigration judges, and public opinion subsided, they decided to go after the interpreters once again.

During the last few days, many immigration interpreters received an email from SOSi notifying them the following changes to their policy:

“…In the coming weeks, we plan to release a competitive Request for Quote (RFQ) to anyone who is interested in continuing to work on the program…”

In other words, in a few weeks, interpreters will have to bid for work at the EOIR, and assignments will go to the lowed bid.  Is SOSi going to pay its interpreters the same rock-bottom fees they had in mind a year ago when their master plan was derailed in part by their ineptitude, but mainly because the quality interpreters refused to work for such insulting fees.

I hope I am wrong, but as I continue to read SOSi’s communication, I detect a Machiavellian cleverness I did not see last year. Let’s read another segment of the same email:

“…In the meantime, we are issuing extensions to current Independent Contractor Agreements (ICAs) at the current rates.  You will have seven days to review and execute those extensions in order to be eligible to continue working on the program past August 31, 2016….”

The way I read the paragraph, and I hope I am wrong, I get the impression that SOSi is taking away from the interpreters the argument of “contracts with rock-bottom fees” by offering its current contractors a new contract under the same professional fees (incorrectly called “rates”).  By doing this, the Defense Contractor turned interpreting service provider, if questioned by EOIR, can defend itself arguing that their individual interpreter contracts contain the same terms as the prior contract, and that the interpreters who work for a lower fee than the one in their contract, do so by voluntarily participating in the “competitive request” process in order to get more work.  Of course, we can assume (from the contractor’s own words) that there will be very few assignments for those interpreters who do not participate in the bidding process. They will probably work only when nobody else is available.

Finally, SOSi’s communication states that “…The goal of the changes is to provide the best, most cost-effective service to the DOJ…”

Of course they have to watch these costs; that is an essential part of their contract with the government. The problem is that they also need to make a profit, and the more the better.  The question is: How can you increase your profit when your client (EOIR) will not pay you more? To me, the answer seems clear:  They will pay less to the service provider (the interpreter).

I could be wrong, but I do not believe that SOSi will pass on to the EOIR the “savings” from low-bidding interpreters on a case-by-case basis. Record keeping and reporting of these individual cases would be more expensive than simply paying the contractually agreed fees.  From the email, I understand that SOSi will get the same paycheck from the government, but their profit will go up from the money they will save by paying the interpreter a miserable fee.  The United States federal budget for 2017 shows an increase on the appropriations that go to the EOIR from 420 million dollars to 428.2 million.  There were no cuts, and in my opinion, even knowing that most of the EOIR budget goes to many other priorities, it is very hard to understand why SOSi would want interpreters to provide the same services for less money. Dear friends and colleagues, I sincerely hope that my appreciations are all wrong and SOSi will honor the contracts, discard the “lower-bid” system that they seem to spouse, and things continue to improve for our immigration court colleagues; but in the event that I may be totally, or even partly right, I believe our colleagues will be better served by sounding the alarm and being in a state of alert and ready to act once again. There are just too many loose ends that require not just an explanation, but a public general commitment by SOSi not to go back to last year’s unsuccessful attempt to pay less for professional interpreting services. I now ask you to please share your thoughts on this issue, and if you have solid evidence (not wishful thinking) to prove my conclusions wrong, please share them with the rest of us.

Some administrators make interpreting very difficult.

Interpreting is an extremely difficult profession. Besides mastering their craft, interpreters must know enough about practically everything, possess the will to research and study, and be confident and clear when assisting others who need to communicate in two different languages. This is a plate full of challenges, sleep-deprivation, and the need to be aware that this is a business where we need to excel if we want to survive.  Unfortunately, too many times this tough profession gets even tougher because of ignorant, incompetent, narrow-minded, or lazy, supervisors and administrators, even when they are well-intentioned and mean no harm to the interpreter or the profession.

We all know that there are good, hard-working, and capable administrators, many of them former interpreters who know what it takes to do a good job (although some former colleagues, for whatever reason, have not been successful as supervisors or administrators). I am not talking about them here. Today I am referring to those who fit the description above and have made the lives of our colleagues impossible, and even nightmarish.

There are many examples of poor decisions and unfortunate actions by these “people in power”, and I am sure you all have your fair share of them. My travels take me to so many places where I hear these stories from frustrated interpreters, so I know, as well as you do, that there are numerous examples where to choose from. This selection process was, at the same time, difficult and easy, but I finally settled for the two cases that I will describe below. In choosing them, I took into account the magnitude of the error, and the impact this has on ourselves and our profession. I say to my friends and colleagues who do not practice in the court system that the examples are from the legal field, but they could easily be from medical, community, military, or conference interpreting.

Some time ago, an administrator in a court setting put an interpreter’s knowledge of his duties, legal procedure, and rules of ethics to the test, by reacting unexpectedly to a very delicate situation.

This seasoned veteran interpreter was working in a trial, together with another colleague who apparently was fairly new to the practice.  They were interpreting for a member of the jury who did not know English (the main language in the jurisdiction where the trial was taking place). Although uncommon, there are places where the law allows people of other languages to be a part of a jury. This was one of those cases.

In the middle of the trial, a police officer was called to testify. During the testimony, he went on to describe how he had learned about the circumstances of the case, and part of what he was describing to the jury, had to do with the manner in which he gained access to the home of the defendant.  At that point, the non-English speaking juror that the interpreters were assisting, passed a note to the judge through the bailiff. The judge read the note, and asked the interpreters to sight translate it for him and the attorneys on a sidebar, so the jury would not hear what this person wrote. The note was a question from the non-English speaker to the police officer who was testifying: The juror wanted to know if the officer had authorization from the owner of the house (the defendant) to enter the property. After discussing it with the attorneys, the judge allowed the question, as in this jurisdiction, like in many others, members of the jury are permitted to ask questions during a trial. The veteran interpreter sight translated the question aloud, for the record and for the benefit of the witness and the jury. The novice interpreter stayed with the interpreting equipment ready to simultaneously interpret back the police officer’s answer to the non-English speaking juror. Once the question was posed to the witness in English by the veteran interpreter, he went back to his place next to the novice interpreter. I do not have the transcription of the exact answer, but after a moment, the police officer responded something like this: “…No… but because of the specific circumstances of the situation, this is one of those exceptions allowed by the statute…” and he went on to describe the circumstances and the exception to the rule. Regardless of the truthfulness of the officer’s statement, for all practical purposes, his answer was that he was acting legally when he entered the property. At that point it was for the jury to assess the credibility of the witness and decide if he was telling the truth. After this answer, the jury was well equipped to make that decision. Unfortunately, the non-English speaker juror did not hear a complete interpretation of the answer given by the policeman. As noted above, the rendition the juror heard in English was as follows, and again, I did not have the benefit of the transcript, so the officer’s answer was something like this: “…No… but because of the specific circumstances of the situation, this is one of those exceptions allowed by the statute…” and he went on to describe the circumstances and the exception to the rule. Sadly, the interpretation by the novice interpreter was: “No”. Nothing else.

When the veteran interpreter, who was sitting next to the novice interpreter heard the rendition, and saw how the novice interpreter just kept going without even trying to correct his mistake, the veteran interpreter worried. He immediately realized that there was a juror who had asked a question, and at this time was at a disadvantage compared to the rest of the jury because an interpreter had omitted a crucial part of the testimony. Dear colleagues, while the other jurors heard how the police officer was legally allowed to enter the house of the defendant, the non-English speaker heard the officer say “no”. He heard him answer to his question by saying that he was not allowed to enter the home. The veteran interpreter tried to make eye contact with his colleague, also wrote him a note, but the novice interpreter ignored the efforts of his fellow interpreter, and avoiding his stare, he just kept going as if nothing serious had happened.

As soon as the veteran interpreter realized that his colleague was not planning to correct the rendition, he wrote a note to the judge asking for a moment to talk to him and the attorneys. The bailiff gave the note to the judge who read it, acknowledged the veteran interpreter, and signaled that he would listen to him as soon as it was prudent to come to a stop in the trial.

A few minutes later, the judge took a recess, asked the jury to leave the courtroom, and in open court, without the presence of the jury, he listened to the veteran interpreter who explained what happened. After some debate by the attorneys, the judge decided that he was not going to tell the jury about the misinterpretation; instead, he considered that the best way to cure the mistake was to allow the prosecution to explain during closing arguments that the officer was legally allowed to enter the defendant’s residence because of an exception to the law and that the police officer knew this when he decided to go inside the house. This is exactly how it happened, and the problem was cured by the judge’s decision and thanks to the skill and quick thinking of the veteran interpreter. After the trial the judge thanked the interpreter for disclosing this issue that otherwise would have gone unnoticed by the court.

This would have been a happy ending for everybody, even the novice interpreter who thanks to the actions of his veteran colleague learned from his mistake without harming the legal process .  Unfortunately, there is more to the story.

When the court administrator in charge of interpreter services found out what had happened during the trial, she immediately asked the veteran interpreter to go see her.  Apparently, when the interpreter got there, she was fuming because, according to her, the interpreter had made a big mistake by writing a note to the judge informing him that he needed to talk to him and the attorneys. In the opinion of this administrator, who is not an interpreter or an attorney, the veteran interpreter needed to stand up and immediately state aloud, for the record, that the interpreters needed to correct something, and then immediately correct the mistake of the novice interpreter by doing a full rendition of the police officer’s answer to the non-English speaking juror.  The veteran interpreter could not believe what he was hearing as the administrator spoke of sanctions to the interpreter for not making the correction right away on the record!

Obviously, the veteran interpreter immediately explained to the administrator that her suggested solution was not even an option, that interpreters need to know the basic rules of criminal proceeding, and that doing what the administrator was suggesting as the solution to the problem would have been nefarious. This action could have risked a mistrial because of an interpreter decision to disclose something to the jury without first informing the judge and the attorneys who should be the ones who, after arguing the facts and the law, decide how to cure the error.  Obviously, the judge thought that in this case, instead of correcting the rendition the way the administrator wanted, the appropriate solution was to fix it on closing statements as they did.  Judges can be wrong, but interpreters should not take over the judge’s function and decide what to do in a trial. Even after this explanation, the administrator did not admit the mistake to the interpreter, perhaps to save face, but she knew that the he was right because no sanction was ever imposed to the veteran interpreter. We can clearly see that, an example of an interpreter doing the right thing to correct a mistake was praised by those who knew the law, but it created undeserved stress and generated unnecessary expenses to the interpreter, who had to be worried about possible sanctions by the administrator, and had to spend a day at the administrator’s office instead of earning a living. Some administrators make interpreting very difficult.

The second case happened to me. As you know, I teach workshops and seminars all over the world. On one occasion, the organizer of a workshop that had hired me to teach, among other things, an advanced ethics seminar, contacted me to let me know that the person in charge of approving continuing education credits in a rural state in the U.S. had informed them that she was not going to grant credits because the title of the seminar did not include the word ethics. I was extremely surprised to hear this because that exact seminar had been approved for continuing education credits many times in the past, and in fact, it had been approved for the same seminar in other jurisdictions.

I sensed the concern on the part of the organizers, because even though the state denying the request for credits was small and we would probably get very few interpreters who needed that approval, if any, they felt (as I did) that the credits were deserved.  To alleviate my client’s concern, I wrote a very detailed explanation to this state officer explaining sentence by sentence how the description of the seminar that she was given from the beginning referred to the Canons of Ethics. I even indicated what Canon applied to each one of the parts of the description of my seminar. I further explained that adding the word “ethics” to a title does not qualify a class as ethics, that my experience as a professional instructor had taught me that to get a big crowd to attend a seminar or workshop you need a catchy title, and that was the reason why I had decided not to go with a boring title with the word “ethics” as part of it. That is why we provide a seminar description so that those deciding to attend can make up their minds. To our surprise, this bureaucrat, who has never been an interpreter, is not a lawyer, and has been in the government for over twenty years, rejected the credits request because “…the description (of the seminar) does not match the title (of the presentation…).” Because of the size of the jurisdiction that she represents, we decided not to pursue the continuing education credits that state anymore. This was a business decision, not an academic one; it did not impact my career or my pocket, but for the purpose of this post, I thought it was important to include this ignorant decision by a person who in the past told a newspaper that to find court interpreters: “…we call restaurants, churches…I found a Kurdish interpreter at Target…” It is no mystery why there are so few certified court interpreters in this jurisdiction, and why they are among the worst paid nationwide.  Our colleagues who deal with this individual regularly know well that some administrators make interpreting very difficult.

Is this practice demeaning to certified court interpreters?

In the United States and other jurisdictions interpreters are officers of the court. From the moment interpreters begin to work in court, they hear the term thrown around all the time. They are told that much is expected from them as officers of the court, and at the same time they see how annoyed some court employees get when an interpreter is part of a hearing.

One of the least pleasurable things about court interpreting is the need to endure uncomfortable attitudes, and absurd policies, by many clerks, support staff, attorneys, court administrators, and even judges. This environment has turned off many excellent interpreters, and deprived non-native speakers of the benefit of some of the most capable and professional individuals.

Court interpreting presents many unavoidable challenges to the professional interpreter, and they have to be dealt with in order to reach the goal of equal access to justice: lay and legal terminology, evasive speakers who at best reluctantly tell the truth, poor acoustics, obsolete interpreting equipment or the lack of it, long hours, and low pay, are some of the realities that court interpreters face every day at work. Most of them cannot be fixed by a bigger budget or more competent court administrators; they are part of the “nature of the beast.” Let’s face it: many people do not go to court voluntarily, some appear before a judge or jury when they are angry, scared, embarrassed, and a good number of them have trouble with telling the truth. Court interpreting is very hard; but not all of its difficulties are due to bad acoustics, a whispering attorney, or a fast-speaking witness. Some of them are generated artificially, they do not belong in the courthouse; they are the result of ignorance and lack of understanding.

When the spirit of justice and the passion for the law are no longer there, many of the top interpreters abandon the field. Being ignored by the clerk, patronized by the judge, criticized by the attorney, and to constantly walk into an environment where the interpreter often feels like he is more of an obstacle to the process than an essential part of the administration of justice, seems to outweigh the low and rarely timely pay. We all know, and have accepted or rejected these circumstances; many are trying to change them through education or negotiating their labor conditions, and many freelance interpreters have relocated their court work from the top of their priority list to the middle and even to the bottom.

The question is my friends: Are we really officers of the court? The legislation says we are, but, what does it mean to be an officer of the court? According to Black’s: an officer of the court is “a person who is charged with upholding the law and administering the judicial system. Typically, officer of the court refers to a judge, clerk, bailiff, sheriff, or the like…” it adds that an officer of the court “…is obliged to obey court rules and… owes a duty of candor to the court…” Interpreters fall into this category as one of “the like”. This has been widely recognized by most state legislations, and it is explained by the United States’ National Association of Judiciary Interpreters and Translators (NAJIT) position paper on the interpreter’s scope of practice: “…By virtue of the role we play in the administration of justice, many courts have stated outright that the interpreter is an officer of the court…” To put it in lay terms: court interpreters are officers of the court because they are part of the judicial system to administer justice, and as such, they are subject to strict professional and ethical rules, and to specific legislation. There is no doubt that especially, certified court interpreters are strictly regulated as professionals: they need to go through a certification or licensing process that culminates with passing a rigorous exam, in most cases (sadly, not the federal program) they must meet continuing education requirements to keep said certification or license, and they have to abide by a code of ethics and professional responsibility. It could be argued that noncertified court interpreters may not fit the description as they do not have to meet all the requirements above. However, even noncertified court interpreters must observe the rules of ethics when working in a court-related case.

So, where is the demeaning practice I mentioned at the top of this post? It is at the time that certified court interpreters are placed under oath over and over again, every day, all over the United States.

To practice their profession, all officers of the court are subject to eligibility requirements: judges, attorneys, and certified court interpreters have to meet them to work in the system. All officers of the court have the duty to obey the law, and the responsibility to act ethically and professionally. For this reason, all of them are required to take an oath: judges take the oath when they are appointed or elected to the bench, attorneys are administered an oath after they pass the bar exam, court clerks take an oath when they are hired by the judiciary. They all take the oath once!

In some states, and in some United States judicial districts, certified court interpreters are only required to take their oath once (for that jurisdiction) and a record is kept in file for future reference. This is a great practice not only because it saves taxpayers money by shortening the hearings, and the savings can be a significant in cases when the same certified court interpreter is administered the oath, in the same courtroom, over ten times in one day. Equally important, from the certified court interpreters’ perspective, is the recognition of their status as officers of the court, and the very important message by the system that certified court interpreters are going to be treated as the professionals that they are.

Unfortunately, to eradicate this demeaning practice that places certified court interpreters as second class officers of the court, we will need more than just educating judges and attorneys, convincing court administrators, and pushing interpreter coordinators who work for the courts so they stand up and support the freelance certified court interpreters on this one. It will require a legislative change in many cases. Believe it or not, there is legislation in some states requiring that interpreters be placed under oath before each court proceeding.

A 2012 decision by the United States Court of Appeals for the Ninth Circuit (U.S. v. Solorio) held interpreters who translate the testimony of witnesses on the stand are covered by Federal Rule of Evidence 604 and that they are subject to “…the administration of an oath or affirmation to make a true translation…” However, the Appeals Court ruled that “…Rule 604 does not…indicate whether such an oath must be administered in any particular manner or at any specified time, including whether the oath must be administered for each trial. The Administrative Office of the United States Courts (AO) has published guidelines on the administration of oath to interpreters, observing that policies in regard to the oath of interpreters vary from district to district and from judge to judge [Guide to Judiciary Policy §350(b)] Although some courts administer oaths to interpreters each day, or once for an entire case, others administer the oath to staff and contract interpreters once, and keep it on file…”

The legal argument above can be used by certified court interpreters to advance their efforts to get rid of this “second-class treatment” by some courts, but the road will not be easy, and in some cases, the biggest obstacle will be bilingual judges in positions of authority who do not quite understand the role of the interpreter as that of an officer of the court. Judge Ruben Castillo, as co-chair of the American Bar Association (ABA) Section of Litigation’s Trial Practice Committee, and presently the Chief Judge for the United States Northern District of Illinois, favors administering the oath for each case, stating that: “…I happen to be a Spanish speaker, and I’ve seen misrepresentations occur…under the pressure of instantaneous interpretation, especially in cases involving a lot of slang…mistakes can occur. When under oath, most people take the job more seriously…” As you can see, devaluating the certified court interpreter’s professionalism is also used to continue this demeaning practice. It is obvious that judges need to be educated to the professional status of the certified court interpreter. The oath does nothing to improve an interpreter’s skills, but it does a lot to show us that there is a long way to go before we can sit at the table as equals in many jurisdictions. I can see a need to place under oath noncertified or occasional interpreters (not all languages have enough demand to generate a professional practice) but certified court interpreters should be treated as all other officers of the court whose professional scope of practice goes beyond that of a witness.

How to Defend Your Rendition and Professional Reputation as an Interpreter.

Good professional interpreters are usually consumed with taking care of their clients, improving their skills, managing their agenda, and marketing to new clients. This takes a lot of time and energy, and it is essential to succeed as an interpreter. Unfortunately, sometimes during their career some interpreters may experience other aspects of the profession that are less pleasant, more time-consuming, and very stressful.

Our professional tools are our brain, mouth, and a language combination. We can make mistakes, we are susceptible to questioning and second-guessing by others, and in our litigious society we are exposed to lawsuits that can leave us with no career, no resources, and a tainted reputation.

There are many circumstances that can affect our career as professional interpreters, but at this time I would like to focus on two of them:

The first one occurs when our work is subject to criticism and questioning by our peers or by others. This often happens in a legal setting. All court interpreters have faced situations when in the middle of a court hearing a judge, attorney, witness, litigant, and even a juror, have interrupted our rendition to correct what we just said. Most of the time we were right and they were wrong. On occasion, because we are not machines, and because nobody can possibly know all regional expressions, these voices do us a favor as they correct our mistake and allow justice to be served. These are the scenarios we usually face when doing our job. It sounds simple and straight to the point: Either we are right and we say so in order to keep the process moving along, or we are wrong, and in that case we correct our error. The same facts are true in a healthcare or community interpreting setting; even at the negotiating table or in the booth during a conference we sometimes make mistakes out of exhaustion, due to bad acoustics, a speaker with a heavy accent, or because we misunderstood a word or term. This is why we have team interpreting, this is why good interpreting equipment, an appropriate conference room, and breaks or recesses are important.

Unfortunately in the real world we have to deal with attorneys who are not happy because their foreign language speaking client or witness is not saying what they wanted them to say in the trial, and with doctors and nurses who want to dodge the consequences of their negligence, and with the party that lost at the business negotiating table, or with the agency that tries to justify the disaster caused by its outdated broken-down interpreting equipment. The first thing they all do is to cast a doubt over the rendition of the interpreter. It is even worse when all of this happens and you know that those who are questioning your work are clearly wrong.

The second situation I want to bring to your attention is when the same individuals mentioned above, decide to go for the jugular and to put the blame on the interpreter’s rendition; so they take you to court. They argue inadequate interpretation and you are sued for damages. How can we defend our work when our rendition is questioned and we know we are right? What can we do to protect ourselves in case somebody takes us to court for damages? There are preventive measures that we can take as interpreters to diminish the possibility of having to defend our work, our assets, and our reputation.

There are also steps we must follow in case our professional work is questioned or attacked in court.

These complex issues have to be addressed, and as true professionals we must be prepared in case this happens to us. For this reason, I will present: How to Defend Our Rendition and Professional Reputation as an Interpreter” during Lenguando Londres in London on September 13, 2014 at 2:30 pm. Can the interpreter’s simultaneous rendition be distracting?

Dear colleagues:

I have been very fortunate in my career. I have worked with some of the very best in the profession, and yes, sometimes I have worked with some colleagues, thankfully very few, who would fall short from that rating. As many of you know, I have worked all over the world and I have worked conference, diplomatic, court, and escort interpreting for many years. During those years I have observed and learned many things from this spectacular interpreters and I have also seen so many different styles.

One of the things that many colleagues do when simultaneously interpreting is that they close their eyes and gesticulate a lot. They use their hands to express what they are saying and to understand the concepts they are absorbing from the speaker. This works fine for them. Their renditions are impeccable. After years of working in a booth next to some of them I have become used to their style. I interpret differently. I do not use my hands or head to express what I am saying. I just sit there without any gesticulation. This works for me just as well as the opposite works for many great colleagues. I have no problem with either style when you are working in the booth and you are out of sight; in fact, I applaud those who have found this to be a tool to improve their interpreting skills. The important thing is to provide a good service and bridge the communication gap between the speaker and his audience.

Unfortunately, I am not so convinced that this effusive style is as effective in court as it is in the booth. Interpreters who work in the courtroom are not shield by the booth. Even if they work with equipment they are not out of sight. The equipment is usually of the portable kind, and even though many courts use wireless transmitters and receivers, the interpreter sits at the table next to the defendant or somewhere else in the courtroom in plain view of all participants: judge, jury, attorneys, witnesses, and defendant.

As part of their work, court interpreters can interpret difficult complex concepts and very detailed information. One of the reasons to have a court hearing is to assess the credibility of witnesses and litigants. The jury’s attention has to be focused on those testifying or arguing the law. The non-English speaker needs to understand what is going on in the courtroom and for that he often has to concentrate. Because of some of my professional interests, I often attend court hearings in different parts of the world and as an observer who is not involved in the process, I have noticed that gesticulating interpreters can be distracting. I have noticed how members of the jury are sometimes more interested and amused by the interpreters hand movements than by the witness’ testimony. I have seen how defendants pay more attention to what the interpreter does than to what the interpreter says. I do not think this is appropriate. I believe that the interpreter who is working in the courtroom has to be aware of the fact that he cannot be the center of attention; that unlike conference interpreters, court interpreters are visible to all. I understand that this may be their natural way to communicate, that they may need to do this to understand the message they are about to interpret. Unfortunately, I do not think that most jurors, attorneys, and litigants can just ignore their gesticulation and focus on the testimony. I think court interpreters should learn to control these movements and concentrate on accurate interpreting while being inconspicuous.

I find this to be a fascinating, delicate, and frankly touchy subject that is not easy to discuss with our colleagues. For a long time I hesitated to write this blog, but I finally did it because I want to hear what you all have to say about it. I ask you to please avoid personal attacks and comments about how gesticulating helps the interpreter. Instead, I invite you to share with the rest of us your thoughts on this issue: Is this interpreting style distracting to those participating in a court procedure?

When the court interpreter asks for a sidebar.

There are times when the court interpreter is already working in the courtroom and he comes across certain information, notices something in the courtroom, or faces a situation that makes his job unnecessarily difficult.  Usually the recourse is to let the judge know. This is an effective way to solve most problems and continue providing interpretation services during the judicial hearing.  Unfortunately, depending on the issue at stake, this is more difficult when working in the presence of a jury.

All court interpreters should know that, to avoid a mistrial, certain things cannot be said in front of an already impaneled jury.  What is left for the interpreter to do under these circumstances?  The same thing attorneys do: Ask for a sidebar.  Now I would like to share a story that happened to me several years ago while I was interpreting during a criminal trial in the United States.

A colleague and I were interpreting for a defendant charged with a crime that involved some horrible physical injuries.  It took the first two days of the trial to pick a jury, and it took the prosecution another three days to present their case to the jury.  The first defense witness took the stand on the sixth day.  It just happened that this witness did not speak English so we had to interpret for both: defendant and witness. We did a consecutive rendition of the testimony and we positioned ourselves next and right behind the witness stand.  We interpreted over the courtroom sound system so the defendant heard all the questions and answers in Spanish.  Direct examination by the defense began that morning. Nothing out of the ordinary to this point except for the fact that the prosecuting attorney spoke Spanish.

It was my turn to interpret so I started the afternoon session. After the first standard questions about the witness’ name and occupation, the defense attorney asked him questions about the facts of the case.  The witness started answering in Spanish and his testimony disputed what up until then the prosecution had advanced as their theory of the case.  It was clear to all Spanish speakers in that courtroom that this testimony was not favorable to the prosecution. As the witness was speaking, the prosecutor stood up and objected to the witness’ answer stating that the testimony was hearsay.  The judge sustained the objection.  It bothered me that this English speaking judge had granted the prosecutor’s objection even before I interpreted the witness’ answer into English. The defense attorney said nothing. Two or three questions later the same thing happened again.  At this time I was very concerned about the direction this was heading to, so when the prosecutor objected for the third time I got up, raised my hand and asked for a sidebar.  The judge and attorneys were a little confused but after hesitating for a fraction of a second the judge asked us to approach. While walking towards the bench I turned to the witness stand and signaled the other interpreter (who was then sitting behind me as she was the supporting interpreter at that time) to join us for the sidebar.

As soon as we were all in front of the judge I voiced my concern. I told the judge that I believed that in order to sustain or deny an objection there has to be something on the record for the objecting party to object to a statement by a witness, and that sustaining or denying an objection without having heard the objectionable statement probably was not the best way to act.  The judge asked me to clarify so I basically told her that my rendition into English reported on the record by the court reporter is the actual testimony, that an attorney who objects to an answer given by a witness in a foreign language is not objectionable unless it is first interpreted into English. Before this happens the answer given in Spanish is not part of the record and therefore, there is nothing to object. My second argument was that the counterpart, the defense in this case, had no way to argue against the objection because he does not speak Spanish and does not know what the witness said.  Finally, I told the judge that in my humble opinion, as a non-Spanish speaker, she would also need to wait for the interpretation of the answer given in Spanish before she could decide what to do with the objection.  There was silence after I spoke. A few moments later the judge said: “He is absolutely right. We have to wait for the interpretation.” We had no more problems with that or any other Spanish speaking witness for the rest of the trial.

About two weeks later I was contacted by the head prosecutor in that judicial district who invited me to give a talk to all of this prosecutors about this issue.  Dear colleagues, do not lose sight of the fact that as interpreters we are officers of the court, and as such, we must use all the tools that the system gives us in order to do our part to preserve the integrity of the judicial process.  During my career I have asked for a side bar in countless occasions when I have faced a situation similar to the one I mentioned above.  Now I invite you to tell us your sidebar experiences and to share with us some of the difficulties you have faced while on the job and how you have solved them.

Dear Colleagues,

Court interpreting can be exciting, interesting, and well remunerated, at times it can be challenging and even frustrating.  It is all part of the job and I accept it as it comes; however, the thing I cannot accept is the noise, poor sound system, bad manners of many attorneys who just won’t stop talking, and the lack of understanding, by many officers of the court, of our need to hear what is being said.

There is a very simple rule: you cannot interpret what you don’t understand and what you can’t hear. It is that simple. Yet, many courthouses have turned into some of the worst possible environments to work.  Many times this happens because of ignorance and lack of will to help improve the court services (which include interpretation for those who do not speak the language used in the courtroom) and on other occasions the courts just turn a blind eye to the problem even though they perfectly know that it is essential for the interpreter to hear what the parties are saying during the hearing.

Among these nightmarish environments to work as an interpreter, we have the attorneys who never stop talking in the courtroom; it seems that they have never thought of taking their conversations to the hallway.  I couldn’t tell you how many times I have overheard conversations about dates from hell, complaints about bosses, stories about spoiled children, and opinions about judges, all while I sat in a courtroom waiting for my case to be called.

Of course I couldn’t leave out of this piece the cheap, old, poorly-kept, and obsolete sound systems that are waiting for all of us at many courthouses.  These artifacts have outlived their useful life and instead of an asset, they constitute an obstacle to our work.  It is very frustrating to try to do your job while the receiver keeps skipping forty percent of your rendition, or when the batteries are so low that you are not sure they will last the entire hearing.  I would like to meet the person who thought that changing batteries, plugging and unplugging equipment, and running around looking for a better transmitter was part of interpreting; and if we are on the “mood” for meeting some of these “pillars of the court interpreting profession,” I would love to meet those who first dared to ask the interpreter to CLEAN THE EQUIPMENT after using it! I have never done it and I sure hope you haven’t either.

We must include all those attorneys who move away from the microphones as they speak, and we couldn’t forget the lawyers who talk so low that nobody can hear them.  Somehow they don’t understand that the interpreter sits behind them (or to the side) and this makes it very difficult to hear them because their voice is projecting the opposite way: towards the judge, witness or jury.  This group’s main characteristic is that after being reminded to speak into the microphone or to speak louder, they do it for about two minutes and then they go back to the old ways.  I guess some of them are just following the lead of that judge who turns away from the microphone when she speaks, or the one who talks so softly that it’s easier to hear when a pin drops in the courtroom even though she is speaking.

Finally, my “favorite”: In some lower courts there is no place for the interpreter to sit in the courtroom.  Interpreters are supposed to sit “wherever” as long as they are not “bothering” anybody else with their work. Often times, the interpreter ends up in the back of a courtroom, behind an easel or a screen, or sitting among the audience.  How can anybody expect you to hear anything under these circumstances?

Of course, it is important to educate the courts. It is necessary to explain that we have to be able to hear what is being said by the judge and the parties over our own voice.  All of this is crucial. We have been “educating” the bench and bar for many years.

Unfortunately, after years of “educating” judges and lawyers, many colleagues and administrators still believe that the solution is to continue. To do the same over and over again until they all finally get it. I disagree.

I think somebody has to say out loud that we have been “educating” them for a long time and it is time for the courts to set the appropriate conditions for us to do our work.  It is time to stop solely “educating” and to start demanding that court administrators and chief judges do their job. We are officers of the court and an essential part to the system. We are not an inconvenience; we are an important step in the administration of justice.

It is true that most federal courthouses now have appropriate equipment, a place for the interpreter, and a noise level adequate for us to do our job, but there is much to be done at the state and lower levels.  It is time for the state judges to start controlling their courtrooms so that people who “need” to talk exit the courtroom, those who need to be heard use the microphones, and those who are in the courtroom to interpret have a place where they can sit, use their computers or tablets, and more importantly, listen to what is being said during a hearing.  We are not mind-readers. We are court interpreters.  Always remember: you can’t interpret what you can’t hear.
