Do we understand what a U.S. federal court interpreter certification really is?

The irregularities on the administration of the United States federal court interpreter certification exam of 2017 prompted a debate among many colleagues, seasoned court interpreters, those who took the test and are still living in the uncertainty this first appearance by Paradigm unexpectedly brought to their lives, and everybody in between. There are many unanswered questions about the way testing was handled, and there will be plenty of them once the results are announced one day. It is unlikely that once the candidates who feel the “sui-generis” administration of the test significantly impacted their performance are told they failed the exam, they will just accept it and move on. Some colleagues in such situation may be lawyering up just in case. Even those who will be told they passed will face situations never faced by any other federally certified court interpreters before. Maybe the results of their exam will be questioned in some spheres. Sure, the federal judiciary will tell them that their certification is as valid as anybody else’s.
That will be true because the certification will be issued by the same Administrative Office of the United States Courts, and they will be retained to interpret in court just like everybody else. Unfortunately, assignments by others, such as law firms and their clients, could bring them some headaches. Everybody other than the federal judiciary is in the private free market where they can hire any interpreter they please. Some potential clients may show reservations, as unfair as it may look to many of us, about the reliability and skill of an interpreter certified on the year of the messy administration of the test. There will be many potential clients who will not care, but sadly, some will, and a possibility is that some of those who will could be the biggest players, the ones who pay the higher fees and handle the high profile cases. This ugly situation, out of the interpreters’ hands, could punish excellent interpreters able to pass the exam, whose skills would never be questioned but for the careless administration of the exam. I hope this does not happen, but it could.
During this, the darkest hour of the federal court interpreter certification exam’s history, I noticed certain things that led me to believe that besides the exam, there are misconceptions about the U.S. federal court interpreter certification.
Setting the current situation aside, the federal court interpreter certification exam is a prestigious exam that measures, to a high degree of reliability, the knowledge and skill of a candidate by testing them on all modalities of court interpretation, criminal legal proceedings, specialized terminology, and language fluency. The exam shows if a candidate meets the minimum standards to provide interpreting services in federal court. Passing the exam is just the beginning, not the end. It does not take us to the finish line, it is just the first step on the track. It troubles me to read comments by colleagues who claim they have not picked a book since they took the test 5 months ago; it concerns me to see how some believe they already forgot so much they think they would fail the exam if they had to take it again.
I worry when I read we have colleagues waiting for the test results to decide where to move permanently to apply for a job in a federal courthouse. I also hear how many candidates believe that, because there is a need for court interpreting services at the federal level, they will be getting tons of work as freelancers in the federal system. First, there are few openings to work full time as a staff court interpreter; to get the job they would have to beat many other more experienced and better known applicants, plus government budgetary concerns which favor a hiring freeze.
They will get work at the federal courthouse, but not as much as they expect. They will soon realize there is a huge difference between the caseload of a federal and a state or county courthouse, next, they will learn that very few cases go to trial in the federal system, that many hearings requiring interpreting services are covered through TIP (Telephone Interpreting Program) with the interpreter working from a courthouse far away. The newly certified court interpreters will be exposed to the strict (compared to most states’) guidelines and policy requiring that the courthouse hire the services of all certified interpreters in the area in a fair and even manner. There is a rotation in several courthouses to meet this policy. Finally, they will come to understand that most assignments given by a courthouse are for half days.
I also get the feeling that some candidates, and even some certified court interpreters, believe the federal court interpreter certification is the panacea. They assume that their certification will get them conference work, electronic media interpreting assignments, and so on. This is false.
A United States federal court interpreter certification in Spanish is proof that the interpreter passed the toughest court interpreter exam in the United States, that she or he has demonstrated to have the minimum qualifications to work in the federal criminal court system, those with the certification can be responsible professionals and reliable individuals who value professional self-improvement to the point they put themselves through the arduous certification process. That’s it.
It does not mean that the certified interpreter has the knowledge and skill to interpret a criminal trial; that is acquired through practice, experience, and constant study. It does not even mean that the interpreter has the minimum skills and knowledge to interpret a civil proceeding. The exam tests no knowledge of Civil Law.
As cherished as a U.S. federal court interpreter certification is, it means little in the world of conference interpreting, or in any other interpreting field. There are excellent conference interpreters who started (and continue to work) in the courts, but their success outside the court setting does not come from the court interpreter certification, it comes from their individual effort and determination to study and prepare as conference interpreters, understanding that the two disciplines are different. I get scared when an agency offers me a conference assignment and tells me they only hire conference interpreters who are federally certified court interpreters. This tells me they are an agency that provides community interpreting services (including legal and healthcare) and that the assignment offered is probably not very good. I have never known of any reputable agency that works with conference interpreters say such a thing. It is the same for healthcare interpreting, that is why there is a different certification to work in hospitals and physicians’ offices.
I sincerely encourage all those waiting for the conclusion of this 2017 federal court interpreter certification exam soap opera, to look closely at their expectations as interpreters certified to work in federal court, and once they understand what they got, and what they did not, to study, practice, and plan their work as a professional interpreter with an eye on the future and both feet on reality, and make the choices right for each one in order to succeed not only as federally certified, but as professional interpreters. What are court interpreters afraid of?

During my many years of practice I have seen and heard a lot of things. As a staff interpreter and as a freelancer, I have attended meetings where court interpreter policy had been discussed. I have many friends and acquaintances who were, and still are, court employees. A good number of them do a good job, others do not. From the staff interpreter’s perspective, these policy meetings are permeated by two very strong forces:
The sense of duty to the profession that these colleagues experience as they hear the sometimes absurd proposals by their bosses. This makes them reflect on the reason why they were hired in the first place: Their knowledge of the profession, so they end up putting themselves in the shoes of the practicing freelance interpreter who is about to be victimized by the judicial system. They have to go through these emotions. No doubt. It happened to me when I worked for the courts.
The second, very powerful force in the meeting room is called the sense of loyalty, the corporate spirit. They are constantly reminded, directly and indirectly, that they are now one of “us”, the court administration; that they are no longer one of “them”, the freelancers. They perfectly understand that loyalty is expected. These two forces clash inside the staffer’s head and heart, and the collision can produce two results:
The clear realization by the staff interpreter that he was hired to present the professional interpreters’ perspective, to make sure that no decision would be made without first considering and evaluating the effects of such changes on the delivery of the service and the quality of the performance. When this happens, the interpreter opposes all nonsense that is about to become institutional policy, and voices his objections out loud, perhaps suggesting a meeting with the freelancers before any decisions are made.
Unfortunately, the second result is the one that prevails most of the time: Staff interpreters, afraid of losing their jobs, or at least the favor of their supervisors, remain silent, and sometimes may even suggest the steps need to implement the new policy despite the freelancers’ opposition. Of course, it is easier to act and react out of fear. Some of these interpreters are more concerned about their retirement than about the interpreting services provided in their jurisdiction. Others are terrified of the idea of losing their job and having to go out there to fight for every single dollar they would have to earn as freelance interpreters. Fear means inaction. It means that harmful decisions, sometimes adopted in good faith by the administration, will become the new rules, and staffers will do nothing to stop it.
This is how bad policy comes to be. How it becomes a reality is up to the freelance interpreters, because once the wrong policy is implemented, independent contractor interpreters have two clear options: They can refuse to work under those circumstances and look for other clients, or they can renegotiate with the courts (sometimes they should even take legal action when the administration has clearly breached the terms of the independent contract they may have with the freelance interpreter).
Unfortunately, many interpreters prefer to submissively accept the new rules and comply, even if it means less income, even when it is demeaning to the profession. They are acting and reacting out of fear. The thought of waking up tomorrow and realizing they do not have to go to court because they were not asked to interpret scares them to death. To them, court work, even in exchange for a rock bottom fee is peace of mind. They firmly believe that as long as they keep working, even when underpaid, they are doing the best they can.
This is the biggest problem that court interpreting faces as a profession in the United States, because, unlike our colleagues in the U.K., too many court interpreters in America are willing to roll with the punches and work more for less and under worst conditions. Many interpreters forget that courts are a client, not an employer. The court administrator and the interpreter supervisor are not their boss, they are a client, and they are not even your best client, as courts pay far less than private clients in the legal field. Interpreters must remember that as providers of a professional service, they are bound by a contract, and so are the courts. Both parties are equal. Nobody is less. Contracts are meant to be negotiated, not blindly accepted; and just like with everything else in life, when the terms of the contract are not what you want, walk away without signing on the dotted line. There are other clients.
When court interpreters start thinking of the courts as their client, not their boss, the free market will kick in, and interpreters, just as attorneys, will be able to get a professional fee. Until then, I am afraid that court interpreting will continue to go backwards. I now invite you to share your ideas and proposed solutions regarding this crucial issue to the future of court interpreting, and please, do not answer by saying that there is no other work outside the courts, because there is.

Every time I read an article about court interpreting, look at your social media posts, or have a face to face conversation with a court interpreter, I cannot help but notice how the working conditions constantly deteriorate. For some time we have witnessed how the court interpreting system of the United Kingdom was completely destroyed and our colleagues had to courageously fight back so the rest of the world knew what had happened in their country. Time continues to run, and nothing has been done to improve that system now run by an entity whose greatest achievement was to sink the quality of interpreting services to an unimaginable low. We have witnessed the difficult times that our colleagues who want to do court interpreting face in Spain. We have heard many stories of court interpreters around the world having to fight for a professional fee, a professional work environment, and respect to the profession.
The situation in the United States is also very sad. It is true that the enforcement of Title VI of the Civil Rights Act has left little choice to the states. Now, state-level courts that want to continue to receive federal funds must provide interpreting services to all non-English speakers who need to have access to the justice system. The new demand for court interpreters beyond criminal cases has “inspired” many court administrators and chief judges to act in new and more creative ways to satisfy the requirement of having an interpreter next to the non-English speaker, even when the quality of this professional service is at best doubtful. To this day, there are jurisdictions where the question is: Does a warm body fulfill the legal requirement of providing interpreter services? Sadly, in some cases the answer seems to be “maybe”.
But the state courts want to comply with the federal mandate, and it seems that some of them will stop at nothing in order to achieve their goal. A popular formula was born: “Get an interpreter for that hearing and try to spend as little as possible”. The origin of this strategy is not clear, but it is obvious that this solution was not conceived by an interpreter. This is not even the brainchild of an administrator who at least has a basic knowledge of the interpreting profession; moreover, this doctrine has been embraced by some federal level courts as well. Let me explain.
Some court administrators have implemented a fee reduction. Today, some interpreters get paid less for their travel time to and from the place where they will render professional services; they get a lower fee, less compensation per traveled mile (kilometer elsewhere in the world) no reimbursement for tolls and bridges, and other very crafty ways that some courts have devised to pay less for interpreting services.
Other courts have increased the level of “scrutiny” and now watch over the court interpreters’ shoulder while they are doing their job; not the way a client observes the work of a doctor, a lawyer, or any professional individual, but the way a person watches over the performance of the guys who dry your car when you take it to the car wash. Many times this breathing on your neck type of scrutiny is enforced by adding paperwork and bureaucratic requirements to the fee payment process. To the interpreters, this means more time spent in the payment process, while making the same money than before the new requirements were in place. They are effectively making less money than before.
Of course there are also courts that now pay a lower fee during the contracted time if the interpreter’s lips are not moving: They pay a partial fee for the break time and travel time, even though the interpreters, who sell their time, have allocated those hours, or minutes, to that court as a client. Now some courts are tossing high fives at each other because they paid the interpreter a full fee for 45 minutes of work and a reduced fee for the 15 minutes in between cases when the interpreter did not interpret because the judge had to go to the bathroom.
And there is more: some jurisdictions have removed themselves from the payment process in those cases when, due to a possible conflict of interest, the court assigns a particular case to a private independent defense attorney, who is a member of a panel of lawyers, who can be appointed to these cases in exchange for a fee that is paid by the judiciary. This jurisdictions do not accept the interpreters’ invoices anymore; they now require the panel attorney to process the interpreter’s invoice and payment, generating two very sad effects: (1) Sometimes, the interpreter will have to wait a long time to get paid because their payment processing is not a top priority to the lawyer, and (2) It will help to keep alive the idea that interpreters are second-class officers of the court who do not deserve the court’s trust, because it is clear that these jurisdictions opted for a system where the attorney will need to access the court’s computer system to process interpreters’ payments, which is “preferable” over a system where interpreters would have to be granted that same access to the system. Why? Because it is too much of a risk to take? You can arrive to your own conclusions, but the fact is that this policy is very demeaning.
My friends, when you see and hear about all these policy changes you have to wonder: As these new strategies were discussed and adopted, where were the court staff interpreters, and the judges, and the administrators who know what interpreting is about? And once they were implemented, why did the freelancers continue to work under these terrible conditions? I now invite you to comment on this policy changes, other rules you may have noticed somewhere else, and the reason why these changes are being implemented with so little opposition.
The secrets of the business world are now available to all interpreters.

Most interpreters are (or were) freelancers in the past. Even many of my colleagues who work as staff interpreters for the government or the private sector do some freelancing on the side: After hours and weekend assignments come to mind.
Although most of us do freelance work, it is also common to run into a colleague who is terrified about the business aspect of the profession. There are so many times when I have listened to my interpreter friends describe themselves as “good interpreters, but bad businesspeople”. I know colleagues who have turned down an assignment because the negotiations with the client were too intense or because the paperwork was so demanding. I understand. I have been lucky and I enjoy the business aspect of the profession, but I recognize that sometimes even the most experienced professionals face scenarios where some specialized knowledge comes in handy. Fortunately, I am going to share some good news with all my interpreter friends and colleagues: Help has arrived!
Today I want to talk about Marta Stelmaszak’s new book: “The Business Guide for Translators”. Despite the title, this is a book that speaks directly to all interpreters, as it covers all of our problems, addresses all of our concerns, and lives up to our expectations.
As most of you know, Marta is a professional interpreter and translator, accomplished author, teacher, scholar, and an entrepreneur. She has been a superstar of the profession for quite some time, a popular blogger, and her online “Business School for Translators” is one of the most popular educational tools for interpreters and translators. I should also disclose that Marta is a friend, that I admire her immensely, and that I got the book as a present.
“The Business Guide for Translators” is a 158-page book that reads easily, it is well-written and throughout the book you get the feeling that Marta is having a conversation with you. It is remarkable how so many complex concepts are explained in plain language so that lay interpreters can relate to the issue, and to the proposed strategy to avoid or solve a problem.
Marta divided the book in four chapters: On the first one: Economics, she deals with the basic concepts that all businessperson should know and understand. After reading the chapter, even the most business-challenged individual will be able to grasp the essentials of capital, supply, demand, investment, inflation and competition. The second chapter is entitled: Strategy. Here, the author explains the ideas of core competence, competitive advantage, value curve and chain, as well as customer segmentation; next, she shows the reader how these principles act in the language industry world, and she presents some well-known strategies while at the same time she encourages the readers to take action in their own lives. The third chapter is called: Business Management. In this part of the book, Marta assumes that the reader has become acquainted with all the basic concepts and strategies, and she is ready to take the language professional by the hand from the beginning. The chapter addresses everything from market research and a business plan, to the delivery of a service that represents an outstanding value, and the growth of the business. The last chapter: Business Practice, is a practically-oriented chapter full of advice, suggestions, and examples on how to contact the new client, how to negotiate the terms of the professional relationship, and how to provide the service, including the follow-up phase.

Interpreting for government contractors: A real nightmare?

I know that working with government contractors is a delicate topic for many of you. I understand that in some cases you are as invested in a project as the contractor, and I also know that these entities and individuals serve a purpose in our system. I have personally worked for many government contractors in my professional career. I have to say that my experiences have been good most of the time, but because I have been shortchanged by a contractor in the past, and because I have heard horror stories from many of my colleagues, I decided to write this blog.
My worst experience with a federal government contractor wasn’t as an interpreter. It was as a translator. Years ago I was hired to do a very large translation that required of many months of hard work. Because of the size, it was agreed that I would receive a big down payment, and that I would deliver the translation in parts. Every time I delivered part of the translation I would get paid for the part that was delivered. I translated one third of the job and I got paid; I translated a second third of the job and I was paid; but when I delivered the rest of the translation I received no money. I repeatedly sent invoices and notices to the same people I had been dealing with for over a year. They first told me that there had been a glitch in the system and I would get the check very soon. Months later they put me through to several people I had never dealt with, and I was told that this payment would take some time because the government had not paid them yet. Finally, after several attempts to talk to somebody and never getting a real human being on the phone, I decided to contact the company’s general manager and I was told that they were not going to pay me, period. They argued that the government had paid them less than expected and that I had already received an important sum of money. I had no choice but to send the invoice to a collections agency and after about a year I got most of the money they owed me. They paid on installments. As an interpreter there was a time when I was offered a job by a contractor. Although I had not worked for this company, I knew colleagues who had and they had shared their horror stories. The proposal was interesting so I decided to talk to this contractor.
It went wrong from the beginning when this person started by telling me: “…of course you are not one of those interpreters that want to charge (he mentioned the amount) dollars per day right? We are offering you a great opportunity, so part of it is that you have to play ball with us and accept (he quoted me a pretty insignificant amount) dollars per day…” I paused for a second and said: “You are right. I am not one of those interpreters who charge (I repeated the amount he had used before) dollars per day. I charge (I quoted a quite larger amount) dollars per day regardless of the great opportunity this may be…” Obviously he did not like my answer and after a few irrelevant exchanges we parted ways. He said that he would get back to me with an answer but I knew he wasn’t going to call again.
A few months went by and I eventually ran into a colleague who works with government contractors all the time. During our conversation about his work, he brought up the name of the individual I met with months before, and said that this contractor I had turned down months before, was in some kind of crisis because he had hired some interpreters for a big job and apparently the client was not happy with the service provided. My friend mentioned that contractors had been under a lot of pressure because the government was looking for lower bids every time, and they had started to cut costs by hiring less experienced and less expensive interpreters. That was the end of the conversation and that was it.
A few weeks later I got a phone call from the same contractor “apologizing” because it had taken him this long to get back on the proposal but that he was ready and we should meet. He never mentioned the fact that he had tried other interpreters first and it backfired. At this point I really didn’t want to work with him because the interpreter fee comment from the first meeting had really bothered me, but we met anyway. He was ready to pay the amount I requested at the first meeting, but this time I asked for more. He seemed surprised and told me he had to think about it. We said goodbye and I never heard from him again. I later learned that his company had not paid in full to any of the colleagues who ended up doing the job. I was really glad I decided not to take the job.
Some interpreters have not been this lucky. Although I didn’t see this first hand, I heard of some colleagues brought to the country on non-immigrant visas sponsored by the contractor, who are not paid regularly, are forced to work overtime for free, and are constantly threatened with the revocation of their visa. Other colleague told me that after being hired by a government contractor for a 2-week job away from his hometown, he was cancelled on the day the job started and the contractor refused to pay him arguing that he had “done nothing…to deserve payment…” totally disregarding the fact that this colleague had made travel arrangements, had turned down other assignments during those 2 weeks, and was not going to make any money for at least a good part of the 2-week period. I know staff interpreters who quit full-time and part-time jobs with government contractors, and I know others, like me, who had to go to collections agencies, and even to court, in order to get paid for work already done. I am not saying that all government contractors are bad people. Some of them are really good. All I am saying is that before signing a professional services agreement with a government contractor, you should check the company out and review the contract very carefully. Contractors are essential in our type of work and we must work together developing strong professional relationships, but we should never forget that despite the glamour and prestige of the job offered, we should always do our homework before signing on the dotted line. Interpreting near the border: Not necessarily a pleasant experience.

As a veteran interpreter I have seen many things, faced numerous obstacles, and solved hundreds of situations such as bad equipment, poor booth location and lack of research materials, noisy courtrooms, difficult accents, and rotten clients. I am sure you had your fair share as well. However, I came to a realization a few weeks ago when I was teaching a seminar in the great State of Texas. I lived in a border state for many years and I had to face the bilingualism problem on a daily basis, but nothing I ever went through compares to the story I am about to tell you:
There is a judge in Houston Criminal Court who has very little regard for her interpreters, this combined with her colossal ignorance of the interpreter profession, of who the officers of the court are , and her self-centered goal of only caring for the next election (because state judges are elected by the voters in Texas) have resulted in a very uncomfortable work environment for our good colleagues.
I lived in New Mexico for many years and I experienced first-hand the constant struggle of interpreting from and into Spanish in a place where most people have an idea of the language and many of them speak it at an average level. It is very difficult to work under these circumstances, especially as a court interpreter because in an environment where the judge, attorneys, clerks, police officers, witnesses, and jurors understand, or think they understand, at least some of what was said in Spanish, puts the interpreter in a place where he or she is constantly on the spot, been “corrected”, receiving unwanted “suggestions”, and sometimes being challenged by one of this so-called Spanish speakers.
There was a case in another state some years ago where a member of the jury, who supposedly spoke Spanish, disapproved of the official interpretation of a witness during a trial and during deliberations informed the other jurors that she spoke Spanish, that she understood what the witness said in Spanish, and that the interpretation had been incorrect. She then told them what in her opinion the witness really said, and that swayed the jury. Because of that comment by the bilingual juror there was a conviction that otherwise would have never existed. Once the circumstances during deliberation were known by the judge and attorneys, the defense filed an appeal that made it all the way up to the State Supreme Court where the conviction was overturned. The reality was that the interpreter had been right all along. The juror did not have the necessary knowledge of the Spanish language to really comprehend what was said and then interpret it into English accordingly (like the interpreter did) In their decision, the Justices clearly indicated that the court, including the jury, has to abide by the official interpretation into English provided by the certified professional court interpreter. That is the record in the case, it is not there to be doubted or debated by other bilingual speakers. As a result of that case judges in that state now read an instruction to the members of the jury clearly telling them to rely on the interpretation and not in what they may believe was said as they are not professionally trained to interpret.
The absolute opposite of what this court decision stated happens every day in this Houston Texas Criminal courtroom. Whenever there is a trial before this judge that requires Spanish interpretation, from the beginning of the proceedings the judge asks the Spanish-speaking jurors to “…let (her) know if something that the interpreter said was wrong… Because (in that case) we’ll try to figure it out, and if we can’t come to an agreement (of what was said) then we’ll get an expert…”
This is what she says with the licensed interpreter (in Texas there are no certified interpreters, they are licensed) present and interpreting to the defendant! Of course, most freelancers now refuse to work for this ignorant “judge”, but the staff interpreters are stuck with her, at least until the next election. Once I heard the story I concluded that no matter how bad we think we have it when doing our job, there is always somebody who has it worse. I would like to see what you think about this situation, and I would love to hear any suggestions you may have for the Houston interpreters who deal with this individual on a daily basis.
